232 <br />All the provisions of this Ordinance shall be in force and effect on and after <br />the 29th day of March, 1939, and all ordinances in conflict herewith are hereby repealed <br />from and after the said date. <br />Such repeal, however, shall not affect any offense or act committed or done or any <br />penalty or forfeiture incurred or any unlawful or prohibited use of property, existing, <br />established or accruing before the repeal of the aforesaid prosivions of said ordinance. <br />Jerk <br />Adopted by the Council March 29, 1939 <br />Ayes: Mr. Gleason, Dr. Haden, Mr. Huff, <br />and Mr. Peyton. <br />No -es: None. <br />re.*i.dent <br />AN ORDINANCE TO REGULATE THE SALE AND DELIVERY OF SOLID FUEL <br />CONSISTING OF COAL, COKE AND ANY MANUFACTURED OR PATENTED FUEL NOT SOLD <br />BY LIQUID OR METERED MEASURE TO CONSUMERS IN THE CITY OF CHARLOTTESVILLE, <br />DESIGNATED "SEC. 126 (1)" OF THE CITY CODE OF 1932, AND ENTITLED ►'CITY <br />SEALER - COAL WEIGHTS - PENALTY". <br />BE IT ORDAINED by the Council of the City of Charlottesville that a new section <br />be added to the City Code of 1932, designated "Section 126 (1)" and entitled "City <br />Sealer -Coal Weights - Penalty", which is hereby enacted so as to read as follows: <br />SEC. 126 (1) CITY SEALER - COAL WEIGHTS - PENALTY. <br />(a) Every person, firm or corporation who shall sell or deliver.or attempt <br />to sell or deliver solid fuel, consisting of coal, coke or any manufactured or <br />patented fuel not sold by liquid or metered measure to consumers in the City of <br />Charlottesville, or who shall solicit, receive of take orders for the sale or <br />delivery of such solid fuel to consumers in the City of Charlottesville, here- <br />in after termed coal dealer, shall before doing so, register his or its name <br />with the City Inspector of Weights & Measures. <br />(b) Every delivery of solid fuel as aforesaid shall be accompanied by <br />a delivery ticket which shall show (1) the coal yard, storage yard, mine tipple <br />or other point of origin, from which delivery is being made; (2) a brief descrip- <br />tion of the kind and grade of solid fuel being delivered attested by the signa- <br />ture of the owner of said point of origin or his agent; (3) the name and address <br />of the person, firm or corporation claiming to be the owner of the load of solid <br />fuel being delivered; (/+) the name and address of the purchaser; and (5) the <br />gross, tare and net weight of the load being delivered taken the same day on <br />which delivery is being made, on scales which have been duly tested, approved and <br />sealed by the Inspector of Weights and Measures of the City of Charlottesville <br />and the date and time the same were taken, and the license number of the vehicle <br />so weighed attested by a weight master appointed by the Inspector of Weights and <br />Measures of the City of Charlottesville. <br />The weights required to be stated on the delivery ticket may also be taken <br />and attested by the Inspector of Weights and Measures of the City of Charlottes- <br />ville or his deputy, and on application by any coal dealer he shall weigh and <br />determine the gross, tare and net weights and attest the same as required in (5) <br />above, for which service the coal dealer whose load is so weighed by the City, <br />Inspector of Weights and Measures or his deputy shall pay to the City five cents <br />per ton of solid fuel so weighed. <br />Any person violating any of the provisions of this sub -section shall upon <br />conviction be Punished by a fine of not less than Ten Dollars ($10.00) nor more <br />than Two Hundred Dollars ($200.00). <br />All Ordinances or parts of Ordinances in conflict herewith are hereby repealed and <br />this Ordinance shdLll be in full force and effect from the date of its passage. <br />Adopted by the Council April 3, 1939. <br />Ayes: Mr. Gleason, Dr. Haden, Mr. Huff, <br />Mr. Jessup, and Mr. Peyton. <br />Noes: None. <br />Preside <br />1 <br />1 <br />1 <br />1- <br />I <br />
