239 <br />On and after the effective time and date of this ordinance, all ordinances or parts <br />thereof in conflict herewith are hereby repealed. <br />Adopted by the Council July 7, 1939• <br />Ayes: 1Ir. uleason, Dr. Haden, Mr. Huff, and <br />1-7 Mr. Jessup <br />Noes: None. <br />Clerk President <br />parked in such parking space shall be parked with the foremost part of such <br />vehicle directed at and nearest to such meter. <br />(6) When any vehicle shall be parked in any space alongside of or next <br />to which a parking meter is located, in accordance with the provisions of <br />this section, the operator of said vehicle shall, upon entering the said park- <br />ing space, immediately deposit, or cause to be deposited, a five -cent coin of <br />the United States of America in such parking meter and the said parking space <br />may there be lawfully occupied by such vehicle during the period prescribed as <br />the period of parking time allowed in said zone. If said vehicle shall remain <br />in such parking space beyond the parking time limit prescribed for such park- <br />ing space, the parking meter shall display a sign or signal showing illegal <br />parking, and in which event the vehicle parted in said parking space shall be <br />considered as par' -ed overtime and beyond the period of legal parking time, <br />and the parking of a vehicle overtime or beyond the period of legal parking <br />time in such parking space shall be a violation of this ordinance and punish- <br />ed as hereinafter set out. It shall be unlawful for any person to cause, <br />allow, permit or suffer any vehicle registered in the name of such person to <br />be parked overtime or beyond the period of legal parking time established for <br />any parking meter zone as herein described. <br />(7) It shall be unlawful and a violation of the provisions of this <br />section for any person to permit a vehicle to remain or to be parked in any <br />parking space adjacent to any parking meter while said meter is displaying a <br />signal indicating that the vehicle occupying such parking space has already <br />been parked beyond the period of time prescribed for such parking space. <br />(8) It shall be unlawful to deposit or cause to be deposited in any <br />meter any slug, device or metallic substitute for a five -cent coin of the <br />United States-. <br />(9) It shall be unlawful for any person to deface, injure, tamper with, <br />open, or willfully break, destroy or impair the usefulness of any parking <br />meter installed under the provisions of this section. <br />(10) Each police officer charged with the duty of enforcing this section <br />shall take the number of any meter at which any vehicle is over -par -'-,,ed, the <br />vehicle tag number of such vehicle, the length of time during which such <br />vehicle is parked in violation of this section, and report the same to the <br />Police Department and make proper complaint touching such violation. <br />Each such officer shall attach to such vehicle a notice to the owner' <br />thereof that such vehicle has been parked in violation of a provision of <br />this section and instructing such owner when and where to report with refer- <br />ence to said violation. Each such owner may, within 48 hours of the time <br />when such notice was attached to such vehicle, pay the Ulerk of the Civil <br />and Police Justice Court a penalty for and in full satisfaction of such <br />violation, the sum of One ($1.00) Dollar for each hour, or fraction thereof, <br />during which such vehicle occupied such parking space in violation of any of <br />the provisions of this section. The failure of such owner to make such pay- <br />ment to the Clerk of the Civil and Police Justice Court, within said 48 hours, <br />shall render such o,,.iner subject to the penalties hereinafter provided for the <br />violation of the provisions of this section. <br />(11) Five -cent coins required to be deposited in parking meters, as <br />,drovided herein, are hereby levied and assessed as fees to provide for the <br />proper regulation and control of traffic on the public streets and to cover <br />the cost of the supervision, inspection, installation, operation, mainten- <br />ance, control and use of the parking spaces and regulating the parking of <br />vehicles in the parsing meter zone hereby created. <br />(12) The Mayor., City Manager and Chief of Police are authorized to set <br />apart, within the parking zones hereby defined, spaces for loading zones, <br />bus stops, taxi stands and other places in which no parking shall be per- <br />mitted. <br />(13) Operators of delivery vehicles may use without deposit any park- <br />ing meter space during the actual loading and unloading of such delivery <br />vehicles. Operators of passenger vehicles, commercial or private, may use <br />without deposit a parking meter space for the purpose of promptly receiving <br />or discharging any passenger. <br />(14) The owner of any vehicle parked in violation of this section shall <br />be prima facie guilty of such violation. <br />(15) Any person who shall violate any of the provisions of this section <br />shall be punished by a fine of not less than Two Dollars and Fifty Cents <br />($2.50) nor more..than Fifty (1,50.00) Dollars for each offense. <br />(16) The provisions of this section shall apply to parking only between <br />the hours of 8 a.m. and 6 p.m. and on days other than Sundays. <br />(17) This ordinance shall be come effective at 8:00 otclock a.m. on <br />Saturday, July 8th, 1939- <br />(18) If any part of this section shall be adjudged invalid or uncon- <br />stitutional, such adjudication shall not affect the validity of the section <br />as a whole or of any provision, or part thereof not adjudged invalid or un- <br />constitutional. <br />On and after the effective time and date of this ordinance, all ordinances or parts <br />thereof in conflict herewith are hereby repealed. <br />Adopted by the Council July 7, 1939• <br />Ayes: 1Ir. uleason, Dr. Haden, Mr. Huff, and <br />1-7 Mr. Jessup <br />Noes: None. <br />Clerk President <br />
