BE IT ORDAINED by the Council of the City of Charlottesville that there be and <br /> <br />there are hereby enacted two new sections to be added to the City Code of 1932, <br /> <br />numbered 489 (76) and 489 (77), which shall read as follows: <br /> <br />Section 489 (76) Registration of Bicycles: <br /> <br />Subsection a. It shall be unlawful for any person to operate or use a bicycle <br /> <br />propelled wholly or in part by muscular power upon any of the streets, alleys, or <br /> <br />public highways of the city, without first obtaining a certificate of registration <br /> <br />from the Chief of Police of the City of Charlottesville and attaching to such <br /> <br />bicycle a metallic registration number. <br /> <br />Subsection b. The City of Charlottesville shall provide metallic registration <br /> <br />plates and seals, together with registration cards, the said metallic registration <br /> <br />plates and registration cards to be numbered in numerical order, beginning with <br /> <br />number one, the design and identification lettering thereon to be approved by the <br /> <br />Chief of Police. It shall be the duty of the Chief of Police to cause to be <br /> <br />attached one of such metallic registration plates to the frame of each bicycle and <br /> <br />to issue a corresponding registration card to the owner of such bicycle upon the <br /> <br />payment of the registration fee herein required. Such metallic registration plate <br /> <br />shall remain attached to the bicycle for which it was issued during the period such <br /> <br />bicycle is operated within the City of Charlottesville. The Chief of Police shall <br /> <br />keep a permanent register in which shall be entered the name, address and age of the <br /> <br />owner of each registered bicycle, the date of registration and sufficient information <br /> <br />to identify such bicycle. <br /> <br />Subsection c. It shall be unlawful for any person to sell or transfer ownership <br /> <br />of any bicycle without reporting to the Chief of Police within forty-eight hours from <br /> <br />the time thereof full and complete information relative to such transfer, so that <br /> <br />such bicycle may be registered in the name of the transferee. The purchaser or <br /> <br />transferee of any such bicycle shall apply for a transfer of registration therefor <br /> <br />within five days from the time the same is acquired by him. <br /> <br />Subsection d. It shall be unlawful for any person engaged in the business of <br /> <br />buying second-hand bicycles, or any parts of second-hand bicycles, to fail to report <br /> <br />to the Chief of Police of the City of Charlottesville within forty-eight hours after <br /> <br />acquiring any second-hand bicycle, or parts thereof, such report to include the <br /> <br />registration number of such bicycle, a description of each bicycle acquired, the frame <br /> <br />number thereof, together with the name and address of the person from whom the same <br /> <br />was acquired. In case of the purchase of any part or parts of bicycles, the report <br /> <br />shall describe each part or parts and give the name and address of the person from <br /> <br />whom the same was acquired. <br /> <br />Subsection e. It shall be unlawful for any person wilfully or maliciously to <br /> <br />remove, destroy, mutilate or alter the number of any bicycle frame registered pursuant <br /> <br />to this section. It shall also be unlawful for any person wilfully or maliciously to <br /> <br />remove, destroy, mutilate or alter any registration plate or registration card issued <br /> <br />pursuant to the provisions of this section during the time in which the bicycle for <br /> <br />which such registration plate or card was issued is operated. Provided, however, that <br /> <br />nothing in this ordinance shall prohibit the Chief of Police from stamping a number on <br /> <br />the frame of a bicycle on which no serial number can be found or on which such number <br /> <br />is illegible or insufficient for identification purposes. <br /> <br />Subsection f. The registration fee to be paid for each bicycle registered shall <br /> <br />be twenty-five cents (25¢). Once a bicycle has been registered in a given name, the <br /> <br />registration thereof may be transferred from one owner to another, without the payment <br /> <br />of an additional fee. The fee above required shall cover all charges incident to <br /> <br />registration, issuance of registration plates and cards. In the event of the loss of <br /> <br />a registration plate or card a duplicate may be issued at the cost of twenty-five cents <br /> <br />(25¢). All fees collected shall be turned over to the City Collector, who shall pay <br /> <br />the same into the City treasury. <br /> <br />Section 489 (77) Penalties. <br /> <br />Every person convicted of the violation of any section of this ordinance shall, <br /> <br />upon the first conviction thereof, be fined not less than One Dollar ($1.00) nor more <br /> <br />than Five Dollars ($5.00), and upon any subsequent conviction thereof, not less than <br /> <br />One Dollar ($1.00) nor more than Twenty-five Dollars ($25.00), or in lieu of such fine, <br /> <br />or in case such fine is not paid, or in addition to such fine, the Court may require <br /> <br />that any bicycle operated by the owner or other person lawfully in control thereof, <br /> <br />in violation of any of the provisions of this ordinance, be removed from the streets <br /> <br />of the City and that the person operating the same in violation of this ordinance <br /> <br />shall not be permitted to operate such bicycle on the streets of this city for a period <br /> <br />not exceeding thirty days, in the discretion of the trial judge. <br /> <br />This ordinance shall become effective on and after the 1st day of January, 1941. <br /> <br />Adopted by the Council December 16, 1940 <br /> <br />Ayes: Mr. Gleason, Dr. Haden, Mr. Nash <br />and Mr. Peyton. <br /> <br />Noes: None. <br /> <br />Clerk Signature <br /> <br />President Signature <br />
