• <br />r] <br />AN ORDINANCE TO AMEND AND REENACT SECTION 2-189.1 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1965, AS AMENDED, <br />CHANGING THE LEGAL HOLIDAY OF VETERANS' TO THE ELEVENTH <br />DAY OF NOVEMBER, IN CONFORMITY WITH SIMILAR ACTION TAKEN <br />BY THE 1973 GENERAL ASSEMBLY. <br />BE IT ENACTED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE, VIRGINIA THAT §2-189.1 OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1965, BE AMENDED AND REENACTED AS FOLLOWS: <br />SECTION 2-189.1 . LEGAL HOLIDAYS <br />IN EACH YEAR, THE FIRST DAY OF .JANUARY (NEW YEAR'S DAY), THE THIRD MONDAY IN .JANUARY (LEE -JACKSON <br />DAY), THE THIRD MONDAY IN FEBRUARY (GEORGE WASHINGTON DAY), THE THIRTEENTH DAY OF APRIL (.JEFFERSON'S BIRTHDAY), <br />THE LAST MONDAY IN MAY (CONFEDERATE MEMORIAL DAY), THE FOURTH DAY OF .JULY (INDEPENDENCE DAY), THE FIRST MONDAY <br />IN SEPTEMBER (LABOR DAY), THE ELEVENTH DAY OF NOVEMBER (VETERANS DAY), THE FOURTH THURSDAY IN NOVEMBER (THANKS- <br />GIVING DAY), THE TWENTY-FIFTH DAY OF DECEMBER (CHRISTMAS DAY), OR WHENEVER ANY OF SUCH DAYS SHALL FALL ON <br />SATURDAY, THE PRECEDING FRIDAY SHALL BE A LEGAL HOLIDAY AND WHENEVER SUCH DAYS SHALL FALL ON SUNDAY, THE MONDAY <br />NEXT FOLLOWING SUCH DAY, SHALL BE A LEGAL HOLIDAY. <br />CLERK <br />ADOPTED BY THE COUNCIL <br />AUGUST 20, 1973 <br />AYES: MR. RINEHART <br />PRESIDENT <br />AN ORDINANCE TO AMEND CHAPTER 18 OF THE CODE OF THE CITY <br />OF CHARLOTTESVILLE, 1965, BY ADDING IN ARTICLE I THEREOF <br />A SECTION NUMBERED 18.19.3 RELATING TO THE AUTHORITY OF <br />THE POLICE DEPARTMENT TO REMOVE CERTAIN VEHICLES PARKED <br />IN VIOLATION OF LAW <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT CHAPTER 18 OF THE CODE OF <br />THE CITY OF CHARLOTTESVILLE, 1965, BE AMENDED, BY THE ADDITION THERETO OF A NEW SECTION NUMBERED 18-19.3 <br />TO READ AS FOLLOWS: <br />SECTION 18-19.3. REMOVAL OF ILLEGALLY PARKED VEHICLES <br />(A) PURSUANT TO THE PROVISIONS OF §18.19.2(G) OF THIS CODE OF THE CHIEF OF POLICE IS HEREBY <br />AUTHORIZED AND DIRECTED TO ORDER THE TOWING OR REMOVAL OF MOTOR VEHICLES, TRAILERS OR SEMI TRAILERS PARKED <br />ON CITY STREETS OR RIGHTS OF WAY OR ALLEYS IN VIOLATION OF LAW IN THE FOLLOWING INSTANCES: <br />(1) ANY VEHICLE PARKED IN SUCH A MANNER AS TO BLOCK OR IMPEDE THE ORDERLY MOVEMENT OF TRAFFIC <br />THROUGH AN INTERSECTION. <br />(2) ANY VEHICLE PARKED IN SUCH A MANNER AS TO BLOCK OR IMPEDE ACCESS TO A PRIVATE DRIVEWAY, <br />OR ALLEY, OR TO ESSENTIAL FIRE OR POLICE SERVICES, INCLUDING VEHICLES PARKED WITHIN 15 FEET <br />OF A FIRE HYDRANT. <br />(3) ANY VEHICLE OBSTRUCTING ACCESS TO A GARBAGE OR REFUSE DUMPSTER, PROVIDED THE LOCATION IN <br />IN WHICH SUCH VEHICLE IS PARKED IS MARKED WITH OFFICIAL SIGNS DESIGNATING IT AS A " NO PARKING " <br />ZONE. <br />(4) ANY VEHICLE PARKED IN A " NO PARKING," " NO STOPPING'' OR'' NO STANDING'' ZONE IN VIOLATION <br />OF §§18-71, 18-72 OR 18-73, PROVIDED SUCH ZONE IS MARKED WITH AN OFFICIAL SIGN DESIGNATING IT AS <br />A ZONE IN WHICH TOWING IS ENFORCED. <br />(5) ANY VEHICLE PARKED IN A PERMIT PARKING ZONE WITHOUT A VALID PERMIT IN VIOLATION OF §§18.1-93.3 <br />OF THIS CODE. <br />(B) THE CHIEF OF POLICE SHALL CONTRACT WITH A GUALIFIED PERSON OR PERSONS OWNING OR OPERATING TOWING <br />AND VEHICLE STORAGE SERVICES TO PERFORM THE REMOVAL AND STORAGE OF VEHICLES AS REQUIRED BY <br />PARAGRAPH (A) OF THIS SECTION. SUCH CONTRACT OR CONTRACTS SHALL BE LET ONLY BY COMPETITIVE BIDS, AND SHALL <br />PROVIDE THAT SUCH OWNER OR OPERATOR OF TOWING AND STORAGE SERVICES SHALL INDEMNIFY THE OWNERS OF VEHICLES FOR <br />LOSS OR DAMAGE OF THE VEHICLES OR CONTENTS THEREOF DURING SUCH REMOVAL OR STORAGE; PROVIDED, HOWEVER, THAT IF <br />NO BIDS ARE RECEIVED AFTER HAVING BEEN DULY SOLICITED BY PUBLIC ADVERTISEMENT SUCH CONTRACT MAY BE LET ON A <br />NEGOTIATED BASIS. SUCH CONTRACTORS SHALL FURTHER BE REQUIRED TO FURNISH THE CITY WITH EVIDENCE OF LIABILITY <br />INSURANCE ADEQUATE TO COVER SUCH INDEMNITY. SUCH CONTRACT SHALL ALSO SPECIFY THE AMOUNTS TO BE CHARGED FOR <br />REMOVAL AND STORAGE. <br />
