(C) REMOVAL OF VEHICLES PURSUANT TO THIS SECTION SHALL BE PERFORMED ONLY IN THE PRESENCE AND UNDER <br />THE DIRECTION AND SUPERVISION OF A POLICE OFFICER, WHO SHALL IMMEDIATELY NOTIFY THE CHIEF OF POLICE OR HIS <br />AUTHORIZED REPRESENTATIVE OF THE FACT OF SUCH REMOVAL. THE CHIEF OF POLICE SHALL FORTHWITH ASCERTAIN THE NAME <br />AND ADDRESS OF THE OWNER AND NOTIFY HIM OF THE PLACE AT WHICH THE VEHICLE MAY BE CLAIMED. <br />(D) THE OWNER OF SUCH VEHICLE MAY RECLAIM IT UPON PAYMENT OF THE CHARGES FOR TOWING AND STORAGE, • <br />WHICH CHARGES SHALL CONSTITUTE A LIEN ON THE VEHICLE IN FAVOR OF THE TOWING AND STORAGE OPERATOR. SUCH <br />CHARGES SHALL BE IN ADDITION TO ANY FINE WHICH MAY BE LEVIED FOR PARKING IN VIOLATION OF THIS CHAPTER. <br />(E) THE POLICE OFFICER SUPERVISING THE REMOVAL OF A VEHICLE HEREUNDER SHALL MAKE CERTAIN THAT IT <br />IS LOCKED OR SEALED IN A MANNER ADEQUATE TO INSURE AGAINST WRONGFUL ENTRY OR USE AND TO SAFEGUARD THE CONTENTS <br />THEREOF. IF THE VEHICLE IS PARKED IN AN UNLOCKED CONDITION HE SHALL MAKE AN INVENTORY OF ANY ITEMS OF OBVIOUS <br />VALUE CONTAINED WITHIN THE VEHICLE PRIOR TO ITS REMOVAL. <br />(F) IN ALL OTHER RESPECTS THE REMOVAL AND DISPOSITION OF SUCH VEHICLES SHALL BE PERFORMED IN <br />ACCORDANCE WITH THE PROVISIONS OF §18.19.2. <br />ADOPTED BY THE COUNCIL <br />SEPTEMBER 4, 1973 <br />AYES: MR. GRANT OF LEASE. <br />THERE IS HEREBY GRANTED TO THE MONTICELLO PLAZA LIMITED PARTNERSHIP, HEREINAFTER CALLED ''LESSEE '', <br />A LEASE FOR A TERM OF TWENTY-FIVE YEARS OF ONE HUNDRED TWENTY-FIVE (125) PARKING SPACES IN THE CITY OWNED PARKING <br />GARAGE TO BE CONSTRUCTED ADJACENT TO CITY HALL AND BOUNDED BY EAST MAIN, FIFTH AND EAST MARKET STREETS, UPON <br />THE TERMS AND CONDITIONS SET FORTH HEREIN. <br />SECTION 2. DATE OF COMMENCEMENT. <br />SUCH TERM OF TWENTY-FIVE YEARS SHALL COMMENCE ON JANUARY 1, 1975. IN THE EVENT THAT UNFORSEEN <br />DELAYS IN CONSTRUCTION OF THE PARKING GARAGE PREVENT OCCUPANCY OF THE LEASED PREMISES ON THE DATE THE RENTAL <br />FOR THE INITIAL YEAR OF THE LEASE SHALL BE PRO -RATED ACCORDINGLY. <br />SECTION 3. RENT. <br />THE AFORESAID ONE HUNDRED TWENTY-FIVE (125) SPACES SHALL BE LEASED TO LESSEE FOR A RENTAL OF $25.00 <br />PER SPACE PER MONTH DURING THE FIRST FIFTEEN (15) YEARS OF THE LEASE. THEREAFTER, THE CITY MAY INCREASE THE <br />MONTHLY RENTAL TO AN AMOUNT EQUAL TO THAT CHARGED BY THE CITY FOR THE MONTHLY RENTAL OF SPACES IN THE REMAINING <br />PORTION OF THE PARKING GARAGE OR IN OTHER CITY OWNED FACILITIES WITHIN THE CENTRAL BUSINESS DISTRICT. SUCH RENT <br />SHALL BE PAYABLE ANNUALLY IN ADVANCE ON OR BEFORE JANUARY 1ST OF EACH YEAR. <br />SECTION 4. USE OF PREMISES. • <br />THE SPACES HEREBY LEASED SHALL BE USED ONLY FOR THE PARKING OF MOTOR VEHICLES BY MONTICELLO PLAZA <br />LIMITED PARTNERSHIP OR ITS AGENTS, EMPLOYEES, CLIENTS, TENANTS, CUSTOMERS OR GUESTS. AT NO TIME SHALL SUCH <br />SPACES BE OFFERED FOR PERIODIC RENTAL OR USE BY THE GENERAL PUBLIC IN COMPETITION WITH THE PUBLIC PARKING <br />FACILITY TO BE OPERATED BY THE CITY OR ITS AGENTS UPON THE SAME PREMISES. ANY VIOLATION OF THIS CONDITION <br />OR USE OF THE PARKING SPACES SO LEASED FOR UNAUTHORIZED PURPOSES SHALL CONSTITUTE GROUNDS FOR REVOCATION <br />OF THE GRANT OF THIS LEASE BY CITY COUNCIL. <br />SECTION 5. ASSIGNMENT. <br />IN THE EVENT THE MONTICELLO PLAZA LIMITED PARTNERSHIP SHOULD BE ADJUDGED BANKRUPT OR VOLUNTARILY <br />DISSOLVED, THEN THIS LEASE MAY BE TRANSFERRED OR ASSIGNED TO ANOTHER PERSON OR BUSINESS ENTITY; PROVIDED, SUCH <br />ASSIGNEE SHALL FIRST ENTER INTO AN AGREEMENT IN WRITING TO ASSUME ALL OBLIGATIONS OF THE LESSEE HEREUNDER. <br />SECTION 6. OPERATION OF GARAGE. <br />THE CITY SHALL OPERATE THE GARAGE IN SUCH MANNER AS TO INSURE ACCESS AT ALL TIMES TO THE LEASED . <br />SPACES BY LESSEE, ITS AGENTS, EMPLOYEES, CLIENTS, TENANTS, CUSTOMERS OR GUESTS. THE CITY FURTHER AGREES TO <br />EMPLOYEE SUCH TRAFFIC CONTROL DEVICES, METHODS OF ACCOUNTING AND SPACE ALLOCATION WITHIN THE GARAGE AS WILL <br />INSURE THE EFFICIENT OPERATION THEREOF, TAKING DUE REGARD FOR THE NEEDS OF LESSEE IN RELATION TO THE USE <br />
