11 <br /> <br /> 5) The Executive Director shall prepare and submit an operating budget for <br />approval by the Policy Board each fiscal year. The budget shall include projected <br />revenue from client fees and other available fimds as deemed appropriate by the Board <br />and operating expenses. The participating localities will at no time incur any costs for the <br />operation ofthe.prograrr~ The Commission on VASAP shall be responsible for fimding <br />any deficit occurring n the operation of the Progran~ <br /> <br /> 6) The commission on VASAP shall be responsible for conducting fmancial <br />audits on the Program at such times as determined by the Commission. <br /> <br /> 7) The Executive Director shall prepare and submit an annual report for approval <br />by the Policy Board within ninety days of the close of the fiscal year. The annual report <br />shall be presented to the governing body of each participating locality after approval by <br />the Policy Board. <br /> <br /> 8) The Program shall be operated by the Board in compliance with the <br />Commission on VASAP Policies and Procedures. <br /> <br /> 9) Title to all property acquired by James River ASAP shall be vested with the <br />Alcohol Safety Action Program so long as two or more localities continue to participate <br />in its operation. In the event that all localities withdraw and the Commission on VASAP <br />withdraws its endorsement, the property owned by the Program shall be disposed of in <br />accordance with the then applicable provisions of the Code of Virginia. <br /> <br /> 10) This agreement shall remain in effect continuously from year to year until <br />termination. Participating localities may withdraw at any time by official action of the <br />governing body and after ninety (90) days written notice to the Policy Board. If a locality <br />withdraws, its representative shall no longer serve on the Board. <br /> <br />g. RESOLUTION: <br /> <br />Waiver of Fees for Dogwood Festival <br /> <br /> WHEREAS, the 52nd annual Dogwood Festival will take place from April <br />17-28, 2001; and <br /> <br /> WHEREAS, it has been requested that Council waive certain license tax <br />and other requirements applicable to the Dogwood Festival, for the duration of <br />the Festival; and <br /> <br /> WHEREAS, City Council is willing to support this request to the extent set <br />forth below; now, therefore, <br /> <br /> BE IT RESOLVED that the following fees and requirements are waived for <br />the Dogwood Festival: <br /> <br /> 1. The carnival business license tax imposed by City Code S.14-23(1) <br /> ($550/day); <br /> <br /> 2. The tent erection fee imposed by City Code S. 5-57 ($10); <br /> <br /> 3. The zoning inspection. <br /> <br /> 4. Fees for inspection of amusement rides associated with festival. <br /> <br /> BE IT FURTHER RESOLVED by the Council that the following matters, to <br />the extent applicable, are not waived: <br /> <br /> 1. Peddler's license and fee imposed by City Code S.14-17(d). <br /> <br /> 2. Polidng deposit for carnival imposed by City Code S. 3-2 ($50/day). <br /> <br /> <br />
