22 <br /> <br /> On motion by Mr. Cox, seconded by Mr. Lynch, the ordinance entitled "AN <br />ORDINANCE TO AMEND AND REORDAFN SECTION 15-t49 (PROCEDURE FOR <br />PARKING VIOLATIONS; PAYMENT OF FINE WITHOUT TRIAL) OF CHAPTER <br />15 (MOTOR VEHICLES AND TRAFFIC) OF THE CODE OF THE CITY OF <br />CHARLOTTESVILL, 1990, AS AMENDED" was offered and carried over to the next <br />meeting for consideration. <br /> <br />APPROPRIATION: $5,000 - FREE BIKE PROGRAM (2na reading) <br /> <br /> Mr. Satyendra Huja, Director of Strategic Planning, said that the City's insurance <br />policy will cover liability for the program. Since the first reading of the appropriation, <br />Mr. Huja said that he has worked with the Recreation Department and the City will buy a <br />certain number of helmets to rent out for bikes downtown. Mr. Huja said that University <br />students may be willing to assist in that financially. Regarding concern about youth <br />riding the bikes, Mr. Huja suggested that the program not be offered in Washington or <br />Tonsler Park initially. The Charlottesville-Albemarle Bicycling Association (CHABA) <br />has agreed to do routine maintenance on the bikes and rules and regulations will be <br />posted at sites. <br /> <br /> Mr. Toscano asked if similar bike programs exist around the country and if so, are <br />they city run programs. <br /> <br /> Mr. Huja said that some programs, such as the one in Boulder, Colorado, are city <br />run. Mr. Huja said that some ofthe programs have had problems with theft. <br /> <br /> Mr. Toscano said he continues to be concerned about the liability issue, and said <br />that if CHABA incorporates, we could just give the bikes to them and let them operate <br />the program. Mr. Toscano said that we could also get CHABA to operate a youth <br />program instead. <br /> <br /> Mr. Caravati said he thinks the City should start and provide seed money for the <br />program for the first year. <br /> <br /> Mr. Toscano said theft is also a concern, and said that as the program is developed <br />in the next few months perhaps the way it is done could change. <br /> <br /> Mr. Lynch said he could support having CHABA operate the program now or <br />when they become incorporated. <br /> <br /> Mr. John BoYle of CHABA said that some bikes will need to be purchased as well <br />as bikes needing to be repaired. <br /> <br /> Mr. TOscano said if there is not an urgent need to act tonight, he would prefer to <br />think it through and find out what the program will actually be. <br /> <br /> Responding to a question from Ms. Richards, Mr. Craig Brown, Deputy City <br />Attorney, said ti,at if Council appropriates the money to an organization, the City would <br />not need to insure the program. <br /> <br /> Ms. Richards asked what the cost would be to CHABA to insure the program, and <br />Mr. Brown said he does not know, but suggested they may not be able to be insured. <br /> <br />It was the consensus of Council to defer the appropriation. <br /> <br />ORDINANCE: REGULATING CELLUL3~R TOWERS (2nd reading) <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Planning, reviewed the revisions <br />proposed to the ordinance, including allowing antennas in residential and historic districts <br />if they are not visible and allowing attacl-anent to electrical transmission towers. The <br />section dealing with residential districts regarding attached towers was taken out, and if <br />there is an existing tower attachment it will be allowed by right. <br /> <br /> <br />
