29 <br /> <br /> Mr. Toscano said he wonders why we would have a grace period, saying you <br />either increase the fines or you don't, and doing so may only kick off more animosity. <br />Mr. Toscano suggested that raising other fines he discussed during the budget process. <br /> <br /> Ms. Richards said she feels there would be no utility in having a grace period <br />unless it was to be for an educational effort regarding the increased fines and availability <br />of alternative parking. Regarding waiving the first ticket, Ms. Richards said that the <br />survey shows that no other localities do this, and noted that at the University of Virginia, <br />the policy of waiving the first ticket invites the violation. Ms. Richards said that waiving <br />the first ticket could result in writing more tickets and taking in less money. <br /> <br /> Mr. Cox said he feels a grace period is ambiguous and feels it Would be much <br />clearer to state what the rules are. Mr. Cox said that the ordinance is pretty clear and <br />suggested that Council implement it and see what happens, and in the meanwhile <br />continue to find additional parking. <br /> <br />Mr. Caravati said he concurs. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 15-149 (PROCEDURE FOR PARKING VIOLATIONS; PAYMENT OF <br />FINE WITH TRIAL) OF CHAPTER 15 (MOTOR VEHICLES AND TRAFFIC) OF <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED" which <br />was offered at the February 20th meeting, was approved by the following vote. Ayes: <br />Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br />ORDINANCE: ZONING ORDINANCE AMENDMENTS <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Planning, explained that the proposed <br />ordinance would add wording requiring special permits for those situations where such <br />access serving a high density residential, commercial or industrial development would <br />cross through land zoned for less intense development. This will not apply to public <br />street dedications and construction to serve subdivisions. <br /> <br /> Mr. Lynch said he feels the Planning Commission and staff have been very <br />responsive in developing these ordinance amendments. <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Richards, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAtNING SECTION 34-731 CHAPTER 34, <br />ARTICLE XIX, DIVISION 2 (ACCESS TO STREET OR ALLEY; PARFdNG NEAR <br />BUILDING ENTRANCES; PARKING WITHIN SETBACKS0 OF THE CODE OF <br />THE CITY OF CHARLOTTTESVILLE, 1990, AS AMENDED" was offered and carried <br />over to the next meeting for consideration. <br /> <br />CONSENT AGENDA <br /> <br /> On motion by Ms. Richards, seconded by Mr. Lynch, the following consent <br />agenda items were approved by the following vote, with the minutes of February 5th <br />corrected by Ms. Richards. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. <br />Toscano. Noes: None. <br /> <br />a. Minutes ofFebruary 5 and I6 <br /> <br />b. RESOLUTION: <br /> <br />Renewing Caf~ Permit for Baggby's <br /> <br /> WHEREAS, Michael B. LaPanta has applied to City Council for a permit to <br />operate an outdoor caf~ on the pedestrian mall at 512 East Main Street in connection with <br />the .operation of its duly licensed restaurant (Baggby's); and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor caf~ is in keeping with <br />the intent of the pedestrian mall, can add significantly to successful commerce in the <br />downtown area, will not unreasonably restrict the movement of pedestrian traffic and will <br />not endanger the public health, safety or welfare; now, therefore, <br /> <br /> <br />
