proposed franchise agreement, and asked if we have a franchise submission if there is no <br />exhibit A attached. <br /> <br /> Ms. Erin Emmott, Counsel for Dominion Telecom, said that the new map, which <br />she presented to Council, has not been discussed with Public Works. <br /> <br /> Mr. Toscano asked what constitutes a submission, and asked when the request <br />was formally submitted. <br /> <br /> Ms. Emmott said she understood that the map could be amended before the <br />second reading. <br /> <br /> Mr. Toscano asked how the franchise is different than those with other <br />municipalities, and Ms. Emmott said that it is very similar and provides Public Works <br />with oversight. <br /> <br /> Mr. O'Connell asked if any of the cable will be put underground, and Ms. <br />Emmott said yes. <br /> <br />Mr. Cox said the City may want to underground lines on that street. <br /> <br />Mr. Toscano noted that the lines on that street are akeady overhead. <br /> <br /> Mr. Mfike Linear, representing Dominion Telecom, said Dominion Telecom <br />would prefer that the cable be underground if it was cost effective to do so. <br /> <br /> Mr. Toscano asked Mr. Linear if he would have a problem writing that into the <br />franchise agreement, and Mr. Linear said no. <br /> <br /> Mr. Toscano questioned whether there would be any additional cost the City <br />would have to incur to underground the cable, and asked whether Dominion Telecom <br />would be willing to include that there would be no additional cost to the City in the <br />agreement if all other parties on the line agree to underground. <br /> <br /> Mr. Brown noted that if Virginia Power agreed to go underground, Dominion <br />Telecom would have to. <br /> <br /> Mr. Toscano said he thinks it is worth thinking that issue through a little more. <br />Mr. Toscano asked that staff check into the date of the franchise submission. <br /> <br /> Ms. Emmott said that the original submission was made in November, but was <br />resubmitted in February due to the medical leave of the City Attorney. Ms. Emmott <br />noted that most of the language in the agreement was suggested by the City's outside <br />Counsel. <br /> <br /> Mr. Toscano asked what happens ifa pole is found to be in the way, and Ms. <br />Emmott said that the agreement provides that Public Works provide notice and time is <br />given to cure the situation. <br /> <br /> Mr. Toscano said he would like to take two more weeks to look at this issue and <br />to figure out if there are ways to give the City more protection and flexibility. <br /> <br /> It was the consensus of Council to defer the ordinance approving the franchise <br />agreement for Dominion Telecom. <br /> <br />CONSENT AGENDA <br /> <br /> Mr. Caravati removed the ordinance increasing fines for illegal parking and <br />resolution requesting VDOT to include programming for the intersection of Mclntire <br />Road/Route 250 Bypass and the Meadowcreek Parkway from the consent agenda. <br /> <br /> <br />
