Ms. Erin Emmott, Counsel for Dominion Telecom, said that the new map, which she presented to Council, has not been discussed with Public Works. Mr. Toscano asked what constitutes a submission, and asked when the request was formally submitted. Ms. Emmott said she understood that the map could be amended before the second reading. Mr. Toscano asked how the franchise is different than those with other municipalities, and Ms. Emmott said that it is very similar and provides Public Works with oversight. Mr. O'Connell asked if any of the cable will be put underground, and Ms. Emmott said yes. Mr. Cox said the City may want to underground lines on that street. Mr. Toscano noted that the lines on that street are akeady overhead. Mr. Mfike Linear, representing Dominion Telecom, said Dominion Telecom would prefer that the cable be underground if it was cost effective to do so. Mr. Toscano asked Mr. Linear if he would have a problem writing that into the franchise agreement, and Mr. Linear said no. Mr. Toscano questioned whether there would be any additional cost the City would have to incur to underground the cable, and asked whether Dominion Telecom would be willing to include that there would be no additional cost to the City in the agreement if all other parties on the line agree to underground. Mr. Brown noted that if Virginia Power agreed to go underground, Dominion Telecom would have to. Mr. Toscano said he thinks it is worth thinking that issue through a little more. Mr. Toscano asked that staff check into the date of the franchise submission. Ms. Emmott said that the original submission was made in November, but was resubmitted in February due to the medical leave of the City Attorney. Ms. Emmott noted that most of the language in the agreement was suggested by the City's outside Counsel. Mr. Toscano asked what happens ifa pole is found to be in the way, and Ms. Emmott said that the agreement provides that Public Works provide notice and time is given to cure the situation. Mr. Toscano said he would like to take two more weeks to look at this issue and to figure out if there are ways to give the City more protection and flexibility. It was the consensus of Council to defer the ordinance approving the franchise agreement for Dominion Telecom. CONSENT AGENDA Mr. Caravati removed the ordinance increasing fines for illegal parking and resolution requesting VDOT to include programming for the intersection of Mclntire Road/Route 250 Bypass and the Meadowcreek Parkway from the consent agenda.
