86 <br /> <br /> Mr. Watts said adding residential would be possible from a zoning standpoint, but <br />the original architect of the garage said that substantial, complicated structural work <br />would be needed to add residential units on top. <br /> <br /> Mr. Lynch asked how long the improvements to the garage are anticipated to last, <br />and Mr. Watts said that each thing has a different life expectancy, and he can provide a <br />schedule on each component to Council. <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Cox, the appropriation transferring <br />funds for the Market Street Parking Garage renovations was offered and carried over to <br />the next meeting for consideration. <br /> <br />ORDINANCE: PERMIT PARKING POLICY CHANGES <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Planning, explained that <br />a committee made up of staff and neighborhood representatives has been reviewing the <br />permit parking policies. The two main areas are downtown and the University of <br />Virginia, and it was decided to first deal with the area downtown as the University area is <br />more complex. Currently the ordinance and policies are been separate, and it is proposed <br />that they be combined into the ordinance. The proposed changes include standardizing <br />the size of parking spaces measured to 22 feet; reducing the number of vehicles allowed <br />to have permits to four per unit; increasing the fee for permits to $25; increasing the fee <br />for violations to $25 (addressed in a separate ordinance); defining proof of residency and <br />vehicle ownership; requiring a uniform location for permits; and including a provision for <br />an area to discontinue permit parking. <br /> <br />Mr. Brown suggested minor amendments to the ordinance. <br /> <br /> Mr. Cox noted that staffhas projected $20,000 in additional funds with the <br />increased fee and said he feels this revenue really should go toward the parking fund. <br /> <br /> Mr. O'Connell said the funds can be dedicated to the parking fund if that is what <br />Council wants. <br /> <br /> Mr. Lynch asked how many permits are allowed ifa house has one off-street <br />parking space, and Mr. Jennifer Brown, Treasurer, said if there is one space then one free <br />permit will be provided. <br /> <br />Mr. Lynch suggested adding this to the ordinance. <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Cox, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAINING CHAPTER 15 (MOTOR <br />VEHICLES AND TRAFFIC) DIVISION' 3 (RESIDENTIAL PERMIT PARKING <br />ZONES AND RESTRICTED PARKING BLOCKS) OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1990, AS AMENDED," as amended by Mr. Brown, was offered <br />and carried over to the next meeting for consideration. <br /> <br />ORDINANCE: DOMINION TELECOM FRANCHISE AGREEMENT <br /> <br /> Mr. Brown explained that Dominion Telecom has requested a five-year franchise <br />to maintain two miles of fiber optic cable, and said there may be a slight modification to <br />the location which will be reviewed by Public Works. Mr. Brown said that the ordinance <br />does not require, and he does not believe the City can legally require, undergrounding the <br />cable. Mr. Brown said the City's right to obtain "in kind" contributions in lieu of <br />franchise fees has been preempted by state law. Mr. Brown said that the City only has <br />the ability to collect public right-of-way fees, which is not recommended at this time, <br />because Dominion Telecom would have the statutory right to reimbursement if lines are <br />relocated if the fee is collected. <br /> <br /> Mr. Toscano said that the legal landscape for granting of franchises of this type <br />has changed substantially.
