147 <br /> <br />PUBLIC BEARING[ORDINANCE: $9.5 MILLION BOND ISSUANCE <br /> <br /> Ms. Rim Scott, Director of Finance, explained that this bond issuance is a planned <br />debt, and $6.9 million of the total will be used for utility projects and will be paid by the <br />three utilities. The remainder will be used for school capital projects. The bonds will be <br />twenty year bonds, and the City has been notified by one ofthe two rating agencies that it <br />has again achieved a AAA bond rating which will result in a low rate for the City. Ms. <br />Scott said the City expects to also receive a AAA bond rating from the second rating <br />agency. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed, <br /> <br /> On mOtion by Mr. Toscano, seconded by Mr. Lynch, the ordinance entitled "AN <br />ORDINANCE AUTHORIZING THE ISSUANCE OF NINE MILLION FIVE <br />HUNDRED THOUSAND DOLLARS ($9,500,000) PRINCIPAL AMOUNT OF <br />GENERAL OBLIGATION PUBLIC IMPROVEMENT BONDS OF THE CITY OF <br />CHARLOTTESVILLE, VIRGINIA, FOR THE PUP.POSE OF PROVIDING FUNDS <br />TO PAY THE COST OF VARIOUS PUBLIC IMPROVEMENT PROJECTS OF AND <br />FOR THE CITY; FIXING THE FORM, DENOMINATION AND CERTAIN OTHER <br />FEATURES OF SUCH BONDS; AND PROVIDING FOR THE SALE OF SUCH <br />BONDS" was offered and carried over to the next meeting for consideration. <br /> <br />PUBLIC HEARING/ORDINANCE: QUITCLAIM OF GAS EASEMENT TO VDOT <br />(SOUTH FOREST LAKES AND STILL MEADOWS SUBDIVISION) <br /> <br /> Mr. Craig Brown, City. Attorney, explained that the two ordinances authorize <br />quitclaim deeds for two gas line easements in Albemarle County. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Richards, the ordinance entitled <br />"AN ORDINANCE TO QUITCLAIM NATURAL GAS LINES LOCATED IN THE <br />STILL MEADOW SUBDIVISION IN ALBEMARLE COUNTY TO THE VIRGINIA <br />DEPARTMENT OF TRANSPORTATION" was offered and carried over to the next <br />meeting for consideration. <br /> <br />pOLICY STATEMENT: NOISE LEVELS ON DOWNTOWN MALL <br /> <br /> Mr. O'Connell explained that Council and staffhave spent months looking at the <br />issue of street musicians on the downtown mall. Staff drafted a noise ordinance based on <br />decibel levels and Council had a demonstration of various noise levels on the mall. As a <br />result of the demonstration, Councilors indicated that they felt it would be extremely <br />difficult to enact such an ordinance. Staff felt it made sense to bring a policy statement <br />for Council's consideration which would indicate their feeling that such an ordinance <br />does not appear to be warranted at this time, but should problems occur in the future, <br />they would reconsider such an ordinance. <br /> <br /> Mr. Lynch said he is happy to see the ordinance tabled for now, and feels it is up <br />to the musicians to make sure there are no problems. Mr. Lynch said he thinks to a large <br />extent they have done that this year. <br /> <br /> Mr. Cox said he also questions the need for an ordinance, and would like to see a <br />"code of conduct" established. Mr. Cox suggested that representatives of the musicians, <br />police and downtown residents sit down and discuss a code of conduct. Mr. Cox said he <br />feels it would also be helpful to identify areas that are appropriate for louder instruments <br />such as bagpipes. Mr. Cox said he would like to have a process to develop baseline rules <br />and disseminate them without it being a law. <br /> Mr. Toscano said that one of the problems with an ordinance is that we may <br />create one that cannot be enforced which will increase frUstration. Mr. Toscano said it <br />would be very difficult to have a noise ordinance during the daytime, but thinks we could <br />have one that goes into effect certain times of the evening to help residents, such as <br /> <br /> <br />
