Ms. Richards suggested putting the code <br />of conduct in the ordinance. <br /> <br /> Mr. Caravati said he likes the idea of refining the mall culture and thinks we <br />should proceed. Mr. Caravati said he thinks it would be appropriate to have a low decibel <br />rate prohibited after midnight or so. <br /> <br /> Mr. Cox said midnight may be too late, and suggested the ordinance take effect at <br />10:00 p.m. on weeknights and later on weekends. <br /> <br /> Mr. Caravati asked the City Attorney to explore a night-time noise ordinance: He <br />said there needs to be a perception that residents can call and get some relief. <br /> <br /> Mr. Brown said that if an ordinance is going to be enforceable the code of conduct <br />would have to be spelled out in the ordinance. <br /> <br /> Mr. Toscano said he feels it would be difficult to have a subjective measurement <br />to determine if some is violating a law. <br /> <br /> Mr. Toscano said it appears to be the sense of Council to work on a code of <br />conduct and to separately develop a night-time ordinance objectively tagged to a decibel <br />level. <br /> <br /> Ms. Richards said she would like to include in the ordinance the expectation that <br />if someone is told to tone down their music they should comply. <br /> <br /> Mr. Toscano said he feels that would be good in the code of conduct, not in the <br />ordinance. <br /> <br /> It was agreed that staff will develop a night-time noise ordinance and recommend <br />a process for'developing a code of conduct. <br /> <br />ORDINANCE: REVISIONS TO PERMIT PARKING ORDINANCE <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, said that staff <br />and citizen representatives reviewed permit parking regulations and the ordinance was <br />amended in May. Following this, it was decided that minor revisions were needed. Mr. <br />Tolbert said that further recommendations regarding permit parking in the University <br />area will be brought to Council at a later date. The changes proposed include including <br />comer lots as affected households; changing the definition of a block; changing the <br />formula for the number of permits provided to multi-family structures; removes <br />restrictions for single family residences; clarifies the residency requirement; and <br />grandfathers the number of permits for multi-family structures. Mr. Tolbert said that the <br />increase in permit parking fees approved in May still does not cover the City's <br />administrative costs for the progran~ <br /> <br /> Mr. Cox asked about the suggestion that the ordinance be deferred to allow the <br />new Traffic Engineer to review it, and Mr. Totbert said that the new Traffic Engineer is <br />not yet familiar with the program, but Ms: Angela Tucker, a professional Engineer, was <br />involved in making the recommendations. <br /> <br /> On motion by Mr. Cox, seconded by Ms. Richards, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAINING CHAPTER 15, DIVISION 3, <br />SECTIONS 15-202, 15-203, 15-203.1, 15-2008, 15-210 OF THE CODE OF THE CITY <br />OF CHARLOTTESVILLE, 1990, AS AMENDED RELATING TO THE <br /> <br /> <br />
