167 <br /> <br />REPORT: STORM WATER MANAGEMENT <br /> <br /> Mr. O'Connell said that federal regulations for storm water management are <br />significant. Mr. O'Connelt said there is a possibility that drainage areas could be ideal for <br />greenways. <br /> <br /> Ms. Judy Mueller, Director of Public Works, explained that in 1990 Phase I <br />requirements were made effective for storm water discharge. The State will issue <br />requirements for Phase II permits which will include: public education and outreach; <br />public participation and involvement; elicit discharge detection and elimination; <br />construction site runoff control; postconstruction runoff controls; and pollution <br />prevention and good housekeeping. Ms. Mueller said that there will need to be great <br />involvement by the public in the process, and recommended that citizen and staff <br />advisory committees be established. <br /> <br /> Mr. Caravati asked if there will be opportunities for cooperation with the <br />University and Albemarle County, and Ms. Mueller said that it is not yet known if it has <br />to be done individually, but if possible, there will be cooperation. <br /> <br /> Mr. Lynch said he would like to start to look at monitoring water now to get a <br />baseline on water quality so we can tell if new programs have any impact. Mr. Lynch <br />said he is apprehensive about creating a new authority, and said he hopes it can be done <br />with the existing authority. <br /> <br />Ms. Mueller said that no new entity is being recommended. <br /> <br /> Ms. Richards asked if the advisory committee will be a joint committee, but Ms. <br />Mueller said she thinks it should start as a City committee and expand in the future if <br />desired. <br /> <br /> Ms. Richard said she often wonders how the site plan process impacts storm <br />water, and Ms. Muelter said that will he looked at. <br /> <br /> Ms. Richards asked if the EPA will be providing funding for the mandates, but <br />Ms. Mueller said no they will not. <br /> <br />~SOLUTION: APPROVING CAF~ PERMIT FOR MOONDANCE CAF]~ <br /> <br /> Mr. Brown said that Moondance Caf6's sidewalk caf6 permit expired last <br />November, but neither they nor staff realized it. Mr. Brown said additional tangu~ge has <br />been added to the resolution as a result of complaints about noise outside the restaurant <br />which authorizes the suspension of the permit when the music section is violated. Mr. <br />Brown noted that this section only applies to music within the caf6 area itself. Mr. <br />Brown said that music outside of the caf6 area will be addressed by the noise ordinance <br />that is before Council, but noted that music that originates from within the building will <br />not be addressed by the resolution or the noise ordinance. <br /> <br /> Mr. Caravati asked for a definition of public nuisance, and Mr. Brown said it is <br />anything that poses a threat to the public safety or ~velfare of the general public, not just <br />an individual. <br /> <br /> Responding to a question from Ms. Richards, Ms. Carey Slaughter, co-owner of <br />Moondance Caf6, said that a band was put outside against her wishes by the manager at <br />the time, noting that he is no longer the manager. <br /> <br /> Mr. Caravati questioned whether the question of music coming from buildings <br />where the doors are open should be addressed in the ordinance. <br /> <br /> Mr. Toscano expressed concern that the word "shall" in the resolution creates <br />tremendous power to shut down cafes, which could have the affect of killing a business. <br />Mr. Toscano suggested the word "may,' or softening the language otherwise to give the <br />ability to work out a solution. <br /> <br /> <br />
