APPROPRIATION: $237,500 - Drug Court Grant (2nd reading) BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that the sum of $237,500.00, to be received as a grant from the Virginia Department of Criminal Justice Services, is hereby appropriated to account 11- 230-032045 in the Grants Fund for the purpose of operating the Charlottesville- Albemarle Drug Treatment Court in Fiscal Year 2001. The Memorandum of Agreement (MOA) between the City. of Charlottesville and the Virginia Department of Criminal Justice Services sets forth the allocation of funds, which are substantially as follows: Offender Aid & Restoration/Jefferson Area Community Correction $ 71,564 Region Ten Community Services Board $123,617 City of Charlottesville $ 42,319 TOTAL $ 237,500 b. APPROPRIATION: $4,500 - Donation for Free Bike Program (2nd reading) BE IT RESOLVED by the Council of the City of Charlottesville, Virgini9a, that the sum of $4,500 from the Dave Matthews Band is hereby appropriated to account 26- 020-051174-50111 in the capital fund for the purpose of funding the Free Bike Prograrr[ RESOLUTION: APPROVING CAFI~ PERMIT FOR BLUE LIGHT GRILL Mr. O'Connell recommended that this caf6 permit be deferred so that the language can be consistent with that approved for the Blue Light Grill. Council agreed that the sidewalk caf6 can continue to operate pending the language change. ORDINANCE: LATE NIGHT NOISE ORDINANCE ON DOWNTOWN MALL (2na reading) Mr. BrOwn passed out a corrected ordinance which reflects the fact that the ordinance, as offered on first reading, includes a start time of midnight on Friday and Saturday nights. The ord'mance entitled "AN ORDINANCE TO AMEND AND REORDA1N SECTION 16-3 (DEFINITIONS) OF CHAPTER 16 (NOISE CONTROL) OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, AND TO FURTHER AMEND CHAPTER 16 BY ADDING THERETO NEW SECTIONS 16-10 (SOUND LEVELS-DOWNTOWN MALL) AND 16-11 (SOUND LEVEL MEASUREMENT)," which was offered at the September 4t~ meeting, was approved by the following vote. Ayes: Mr. Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. PUBLIC Ms. Jill Williams, a resident of the downtown mall, thanked Council for adopting the noise ordinance for the downtown mall. OTHER BUSINESS Mr. O'Connell reminded Councilors of the Transit Development Plan work session on Thursday. Mr. O'Connell said that the living wage ordinance, which is scheduled for a public hearing on October 1 st, is be available to the public.
