192 <br /> <br /> Mr. Toscano said he is not sure what #7 means, asking what the changes <br />would depend on, and suggested that the amount could be adjusted to the floor <br />wage of City employees rather than accept the amount whatever group comes to <br />Council advocating for at a particular time. <br /> <br />Mr. Cox said he understands it to mean as compared to City employees. <br /> <br /> Ms. Richards noted that there is no definition of living wage in the <br />ordinance. <br /> <br /> Mr. Cox said he feels it would be better to have discretion to compare the <br />wage to floor wage of City employees. <br /> <br /> Mr. Brown suggested saying "maintain parity with the lowest starting salary <br />for City employees," and Mr. Lynch and Mr. Cox accepted this language. <br /> <br /> The amendment of#7 was approved by the following vote. Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br /> Mr. Toscano said he would prefer to include a sunset clause, or re- <br />enactment clause in two years, and if Council did not readopt the ordinance it <br />would expire. Mr. Toscano said Council is entering new territory and the impact is <br />not understood, though it is probably not great given the small number of <br />contractors affected. Mr. Toscano said a lawsuit may be filed. Mr. Toscano said he <br />does not thir~k it hurts in terms of good public policy to revisit the ordinance. Mr. <br />Toscano offered an amendment to the ordinance to sunset it in two years. <br /> <br />Mr. Caravati seconded the motion. <br /> <br /> Ms. Richards said her concern about the sunset clause is that it suggests that <br />the commitment is likely to wane, and wondered if the issue could be resolved by <br />having a longer time period as two years is not enough time to evaluate the impact <br />of the ordinance. Ms. Richards said we need to [-mow if it impacts people doing <br />business with the City, and proposed a minimum of four or five years, and that the <br />ordinance would automatically re-enact after that time period unless Council <br />chooses to amend or repeal it. <br /> <br />Mr. Cox said he feels all believe in the ordinance's likely success. <br /> <br /> Mr. Toscano said that what Ms. Richards proposes is no different than <br />Council's ability to change any ordinance at any time. <br /> <br /> Mr. Lynch said he hopes Council will not come back and review the <br />ordinance, and thinks it says something about commitment. Mr. Lynch said it took <br />a lot of civic energy to bring the ordinance to this point, and he would rather the <br />advocates of the ordinance take this to the next level. Mr. Lynch said Council <br />always has the option to review the ordinance. <br /> <br />Mr. Caravati said he does not see a sunset clause as negative. <br /> <br /> The amendment to include a sunset clause was defeated by the following <br />vote. Ayes: Mr. Caravati, Mr. Toscano. Noes: Mr. Cox, Mr. Lynch, Ms. <br />Richards. <br /> <br /> Ms. Richards suggested that the ordinance be re-enacted every four years <br />unless Council votes to amend or repeal it, but Mr. Cox said all ordinances already <br />do that. <br /> <br /> The ordinance was unanimously approved, but Mr. Toscano asked for a re- <br />vote as he did not understand that the vote was for the final ordinance. <br /> <br /> <br />
