193 <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Toscano, Council agreed to <br />reconsider the vote on the following vote. Ayes: Mr. Caravati, Mr. Cox, Ms. <br />Richards, Mr. Toscano. Noes: Mr. Lynch. <br /> <br /> Mr. Toscano said he continues to have problems with the ordinance, though <br />all are united in feeling that people should earn a living wage, Mr. Toscano said he <br />supported governmental action to increase the wages fOr all City employees, but <br />when it comes to moving into this terrain, he feels it is good politics but not sure it <br />is good policy. Mr. Toscano said it does not solve the problem of poverty, and the <br />question is what is the appropriate role for local government. Mr: Toscano noted <br />that the effort in the General Assembly to give localities power to enact such an <br />ordinance was defeated, and it is a real live issue of whether the ordinance is legal, <br />though the City may have enough exceptions that it may be legal. Mr. Toscano said <br />the sunset clause may have allowed him to vote for the ordinance, and said he <br />appreciates Council's willingness to revisit the vote. <br /> <br /> Mr. Caravati said he appreciates Mr. Toscano's argument, and said he hopes <br />Council will look at the issue every year and how it affects people served and the <br />City. Mr. Caravati said he will support the ordinance with some misgivings. Mr. <br />Caravati cautioned that the ordinance might have a negative impact on who is hired, <br />and could potentially impact minorities. <br /> <br /> Ms. Richards said she thinks the legal situation is ambiguous, noting that the <br />legislation denying localities the authority to enact such an ordinance was also <br />defeated. Ms. Richards said she does not think the will of the Legislature has <br />spoken, and feels it is the role of localities, given that kind of ambiguity, to move <br />forward and fill that hole. Ms. Richards said if the ordinance does get challenged, <br />the City should defend it to the best of our ability. Ms. Richards said that if the <br />State won't lead, localities must. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAiN <br />CHAPTER 22 (PUBLIC PROCUREMENT), ARTICLE II (COMPETITIVE <br />PROCUREMENTS) OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1990, AS AMENDED, BY ADDING THERETO A NEW SECTION 22-82 <br />(LIVING WAGE REQUIREMENT)," as amended, which was offered at the <br />October 1~t meeting, was approved by the following vote. Ayes: Mr. Caravati, Mr. <br />Cox, Mr. Lynch, Ms. Richards. Noes: Mr. Toscano. <br /> <br />RESOLUTION: DECLARATION OF WATER EMERGENCY <br /> <br /> Mr. O'Connell explained that the resolution will give staff the authority to <br />require mandatory water conservation once the reservoir levels reach a certain <br />point. <br /> <br /> Ms. Judy Mueller, Director of Public Works, reviewed water conservation <br />efforts by the City. <br /> <br /> Mr. Caravati said that one of the State climatologists appeared to disagree <br />that there is a water emergency, and Ms. Mueller said that if anyone is unconvinced <br />they should look at the reservoir at Sugar Hollow. <br /> <br /> Ms. Richards said she does not think citizens are aware of how bad things <br />are, and feels they need to be alerted to the situation~ <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Richards, the Resolution <br />Declaring a Water Emergency was approved by the following vote. Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano.
