195 <br /> <br />RESOLUTION: SETTLEMENT OF LAWSUIT <br /> <br /> The Resolution regarding Settlement of a Lawsuit was approved by the <br />following vote. Ayes: Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: <br />Mr. Caravati. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, <br />upon the recommendation of the City Attorney, that settlement of the following <br />described lawsuit against the City is hereby approved and ratified, and the Director <br />of Finance is authorized to make payment from the Risk Management Fund in <br />accordance with this resolution: <br /> <br />Settlement of lawsuit for $65,000 for personal injury related to slip <br />and fall accident on August 29, 1998 on Second Street near the <br />downtown mai1. <br /> <br /> Notwithstanding the above, it is understood that settlement of this lawsuit in <br />no manner acknowledges liability on the part of the City for the claim described <br />above, and the City Attorney shall ensure that a proper release is secured from the <br />plaintiff before disbursing any funds. <br /> <br />ORDINANCE: CLOSING ALLEY OFF CARLTON ROAD (JOTZ PLAZA <br />PROJECT (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING AN ALLEY OFF CARLTON ROAD," which was offered at <br />the January 2, 2001 meeting, was approved by the following vote. Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. <br />Abstaining: Mr. Toscano. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br />Mr. Caravati encouraged everyone tovote in the November 6t~ election. <br /> <br />Council reconvened in closed session. <br /> <br /> Council reconvened in open session and, on motion by Mr. Toscano, <br />seconded by Mr. Lynch, approved the following certification of closed meeting by <br />the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. <br />Toscano. Noes: None. <br /> <br /> WHEREAS, the City Council has convened a closed meeting on this date <br />pursuant to an affirmative recorded vote and in accordance with the provisions of <br />the Virginia Freedom of Information Act; and <br /> <br /> WHEREAS, Section 2.2-3711 of the Code of Virginia requires a <br />certification by the Council that such closed meeting was conducted in conformity <br />with Virginia law; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council <br />hereby certifies that, to the best of each member's knowledge, (i) only public <br />business matters lawfully exempted from open meeting requirements by Virginia <br />law were discussed in the closed meeting to which this certification resolution <br />applies, and (ii) only such public business matters as were identified in the motion <br />convening the closed meeting were heard, discussed or considered by the Council. <br /> <br /> <br />
