233 <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Cox, Council voted (Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: .None.) to meet in <br />closed session for the purpose of discussion of prospective candidates for appointment to <br />City boards and commissions, and for the annual performance evaluation of the City <br />Manager, as authorized by Section 2.2-3711(A)(1) of the Virginia Code; for the purpose <br />of discussion of the disposition of publicly held real property on Cherry Avenue, on 4t~ <br />Street, N. W. (two properties), on Preston Avenue, and on Monroe Lane, where <br />discussion in open session would adversely affect the negotiating strategy of the City, all <br />as authorized by Section 2.2-371 l(A)(3) of the Virginia Code, for discussion concerning <br />the expansion of an existing business in the City where no previous announcement has <br />been made of the business' interest in expansion, as authorized by Section 2.2-3711 (A)(5) <br />of the Virginia Code; and for consultation with legal counsel regarding a specific legal <br />matter requiring the provision of legal service by counsel, as authorized by Section 2.2- <br />371 l(A)(7). <br /> <br /> Council reconvened in open session and, on motion by Mr. Toscano, seconded by <br />Mr. Lynch, approved the following certification of closed meeting by the following vote. <br />Ayes: Mr, Caravati, 1Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. <br /> <br /> WHEREAS, the City Council has convened a closed meeting on this date <br />pursuant to an affirmative recorded vote and in accordance with the provisions of the <br />Virginia Freedom of Information Act; and <br /> <br /> WItEREAS, Section 2.2-3711 of the Code of Virginia requires a certification by <br />the Council that such closed meeting was conducted in conformity with Virginia law; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council hereby <br />certifies that, to the best of each member's lmowledge, (i) only public business matters <br />lawfully exempted bom open meeting requirements by Virginia law were discussed in <br />the closed meeting to which this certification resolution applies, and (ii) only such public <br />business matters as were identified in the motion convening the closed meeting were <br />heard, discussed or considered by the Council. <br /> <br />APPOINTMENTS: BOARDS AND COMMISSIONS <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Cox, Mr. David Simmons and Ms. <br />Ava Baum were reappointed to three-year terms on the Personnel Appeals Board. These <br />terms will expire on December 31, 2004. <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Cox, Ms. Grace Tinstey was <br />reappointed to a three-year term on the Citizens Advisory Committee for the Public <br />Defender's Office. This term will expire on December 3 I, 2004. <br /> <br /> <br />
