10 <br /> <br />4. At no time shall more than thirty (30) persons be present within the principal <br /> building located at this site. <br />5. When children are playing or otherwise congregating in groups outdoors on the <br /> property their activities shall be supervised by at least one adult, to ensure the <br /> safety of the children and to ensure that any noise generated by those activities <br /> will not unreasonably disturb adjacent properties. <br />6. During its summertime operations, the child education center may offer one meal <br /> per day, at lunchtime, to children utilizing the center. Such meals shall be <br /> provided in accordance with state and local health department regulations, if any <br /> such regulations apply to the center's activities. Otherwise, there shall be no <br /> meals provided. This prohibition shall not preclude the child education center <br /> from making snacks available to children at any time. <br />7. At least four (4) off-street parking spaces shall be provided to serve the child <br /> education center, either on-site or by agreement with an adjacent property owner. <br />8. Pursuant to City Code 34-944(a) the standards for improvement of off-street <br /> parking set forth within City Code 34-728 are hereby modified, to waive the <br /> requirements of that section. This exception is necessary or desirable in view of <br /> the particular nature and circumstances of the proposed child education center. In <br /> the event that this property is selected by Neighborhood Development Services to <br /> participate as a test site for materials under consideration by the City as suitable <br /> alternatives to asphalt or gravel surfaces for improved parking areas, then any <br /> improved parking provided shall be of such dimensions and materials approved <br /> by the Director of Neighborhood Development Services as being consistent with <br /> the residential character of the surrounding neighborhood. <br /> Not more than one exterior sign may be utilized. The dimensions ofthe sign shall <br /> not exceed one (1) square foot. <br />10. A ramp shall be established to provide access to the principal building on the site <br /> for handicapped persons. <br />11. This special permit shall apply to the property for which it is issued so long as the <br /> property is used for the use described herein. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Lynch, Council voted (Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None.) to meet in <br />closed session for the purpose of discussing the terms and cost of the acquisition of real <br />property located on Avon Street for a public purpose, where discussion in an open <br />meeting would adversely affect the negotiating strategy of the City, as authorized by <br />Section 2.2-371 l(A)(3) of the Virginia Code. <br /> <br /> Council reconvened in open session and, on motion by Mr. Cox, seconded by Mr. <br />Lynch, approved the following certification of closed meeting by the following vote. <br />Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. NoeS: None. <br /> <br /> WHEREAS, the City Council has convened a closed meeting on this date <br />pursuant to an affirrnative recorded vote and in accordance with the provisions of the <br />Virginia Freedom of Information Act; and <br /> <br /> WHEREAS, Section 2.2-3711 of the Code of Virginia requires a certification by <br />the Council that such closed meeting was conducted in conformity with Virginia taw; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council hereby <br />certifies that, to the best of each member's knowledge, (i) only public business matters <br />lawfully exempted from open meeting requirements by Virginia law were discussed in <br />the closed meeting to which this certification resolution applies, and (ii) only such public <br />business matters as were identified in the motion convening the closed meeting were <br />heard, discussed or considered by the Council. <br /> <br /> <br />
