9 <br /> <br /> Mr. Toscano said that the USDA food program requires that whoever shows up at <br />the site has to be served, and asked if they have decided not to do this in the summer. <br /> <br /> Ms. Grant said she does not think they have decided to do away with the USDA <br />program. <br /> <br /> Mr. COX said he had understood they had made the choice to do without the <br />USDA program. <br /> <br /> Mr. Toscano asked what other uses could go on the site since the special permit <br />runs with the land, and Mr. Higgins said that the permit could be tied to their specific use. <br /> <br /> Mr. Lynch said that he supports what the group is doing but is somewhat <br />concerned about the tight quarters in the neighborhood. <br /> <br /> On motion by Ms. Richards, seconded by Mr. Lynch, the resolution approving a <br />special permit to use 1013 Grove Street as a private educational/recreation/group facility <br />was approved by the following vote. Ayes: Mr. Cox, Mr. Lynch, Ms. Richards. Noes: <br />Mr. Toscano. Abstaining: Mr. Caravati. <br /> <br /> WHEREAS, pursuant to the Code of the City of Charlottesville, section 34- <br />147(1), The Growing Youth Ministries ("GYM"), a faith based organization, has <br />requested a special permit to allow a child education center to be operated at 1013 Grove <br />Street, which property may further be identified as 2002 Tax Map 23, Parcel 2; <br /> <br /> WHEREAS, a joint public hearing on this application was held before the City <br />Council and Planning Commission on February 12, 2002, following notice to the public <br />and to adjacent property owners as required by law; and <br /> <br /> WHEREAS, the proposed child education center will offer services in the nature <br />of a combination day-care and educational facility, free of charge, to children who are <br />school age or older; and <br /> <br /> WHEREAS, the applicant has volunteered to participate in any opportunity <br />offered by the City's Department of Neighborhood Development Services to utilize the <br />property as an test site for materials under consideration by the City as suitable <br />alternatives to asphalt or gravel surfaces for improved parking areas; and <br /> <br /> WItEREAS, this City Council finds and determines that the proposed use is one <br />authorized pursuant to CiW Code sections 34-147(1) and 34-139(5), and that it will <br />conform to the criteria applicable to special permits under Chapter 34 of the City Code; <br />now, therefore, <br /> <br /> BE IT RESOLVED by the City Council of the City of Charlottesville, Virginia <br />that a special permit is hereby GRANTED for a child education center to be located at <br />1013 Grove Street. This Special Permit is made subject to the following conditions, to <br />protect against any undue adverse impact on the surrounding neighborhood: <br /> <br />1. This Special Permit is granted for the following propose: to allow use of the <br /> property for a child education center. As used in this Resolution, the term child <br /> education center refers to a facility that offers a combination of child care and <br /> educational services, as follows: computer skills training, educational tutoring, <br /> religious instruction, snacks, a lunch program (summertime) and supervised <br /> recreational activities, free of charge, to children who are school age (first grade) <br /> or older. <br />2. The use authorized by this Special Permit is limited to the following hours of <br /> operation: (a) during the City's regular school year, Monday through Thursday <br /> (3:00 p.m. to 7:00 p.m.), Friday (6:00 p.m. to 9:00 p.m.); Sunday (10:00 a.m. to <br /> 1:00 p.m.); and (b) during the City schools' summer break, Monday through <br /> Friday (11:00 a.m. to 9:00 p.m.) and Sunday (10 a.m, to 1:00 p.m.). <br />3. During the hours of operation authorized by this Special Permit, at least two (2) <br /> adults shall be present at alt times. <br /> <br /> <br />
