39 <br /> <br />PUBLIC HEARING/ORDINANCE: PERMIT PARKING IN UNIVERSITY <br />NEIGHBORHOODS (2nd reading) <br /> <br /> Mr. O'Connell explained that changes were made in the permit parking ordinances <br />as a result of neighborhood concerns and suggestions by Council. <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, reviewed the <br />revisions to the ordinance: times for permit parking in zone 1, which includes existing <br />permit parking zones, will not change unless the neighborhoods in the entire zone petition <br />to change the times; 2) the process for submission and action on petitions for permit <br />parking is clarified; and 3) streets which were proposed to be included have been <br />removed if there was controversy about their inclusion. Mr. Tolbert said that the f <br />resolution designating streets has also been changed to reflect neighborhood concerns. <br /> <br /> Ms. Richards asked about the suggestion by the Mayor that Jefferson Park Avenue <br />be included, and Mr. Tolbert said that no one has requested that Jefferson Park Avenue <br />be included and no survey information has been presented to back up the suggestion. <br /> <br /> Responding to a question from Mr. Lynch, Mr. Tolbert that said that existing <br />parking zones will keep their current times, but the neighbors can petition to change the <br />times. <br /> <br /> Mr. Lynch asked what the process is to change the times, and Ms. Lisa Kelley, <br />Deputy City Attorney, said that there is no specific process for that, but the best way <br />would be to submit a petition, have staff conduct a survey, and have Council change the <br />time by resolution. <br /> <br />Mr. Lynch suggested that Council adopt that process since it is not in the ordinance. <br /> <br />The public hearing was opened. <br /> <br /> Mr. Morton Roberts, Wayside Place, said that the resolution should read the first <br />1,200 feet of Wayside Place because the first 400 feet are designated as no parking <br />currently. <br /> <br />As there were no further speakers, the public hearing was closed. <br /> <br /> Mr. Tolbert said that Mr. Roberts is correct and suggested that the resolution be <br />amended to reflect this correction. <br /> <br /> Mr. Caravati said that he has heard some concern from residents on the north of <br />Edgewood Lane that the timing on Saturday night might be too restrictive, but he <br />suggested that the time be adopted and any problems can be addressed at a later time. <br /> <br />Mr. Tolbert noted that an opt-out provision has been added to the ordinance. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />CHAPTER 15 (MOTOR VEHICLES AND TRAFFIC), DIVISION 3 (RESIDENTIAL <br />PERMIT PARKING ZONES AND RESTRICTED PARIKING BLOCKS)," which was <br />offered at the April 15~ meeting, was approved by the following vote. Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br />RESOLUTION: DESIGNATING STREETS FOR PERMIT PARKING <br /> <br /> Mr. Cox made a motion to amend the resolution to designate the first 1,200 feet of <br />Wayside Place for permit parking, Mr. Lynch seconded the motion, and the amendment <br />was approved by the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. <br />Richards, Mr. Toscano. Noes: None, <br /> <br /> On motion by Mr. Cox, seconded by Mr. Lynch, the resolution designating streets <br />for permit parking, as amended, was approved by the following vote. Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br /> <br />
