108 RESOLUTION: ACCEPTING HAMMOND STREET RESOLUTION: GRANTING A SPECIAL PERMIT FOR MANU- FACTURING AND PROCESSING ESTA- BLISHMENT ORDINANCE: DISPOSAL OF UNCLAIMED PERSONAL PROPERTY ORDINANCE:. PERPETUAL CARE FUND BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that the sum of $235.00 received from various private donors as an expression of gratitude for services performed by the City Fire Department, is hereby received as revenue in the General Fund and appropriated to expenditure account 01-22011-5504 to be expended as directed by the Fire Chief for the benefit of Fire Department personnel. This item was withdrawn from the agenda, to be discussed at a future meeting. Mr. Satyendra Huja, Director of Community Development, addressed Council, explaining that the~Planning Commission recommends approval of a special permit to use the property at the northwest corner of Monticello Road and Druid Avenue for a manufacturing and processing establishment of a craft nature in a B-3 zone. Mr. Huja explained that the proposed use would involve the processing of "green ware" for use and sale as part of a ceramics business. Council discussed the proposed special permit and expressed concerns of disapproval of the Planning Commissinn's recommendations to provide a waiver of the sidewalk and curb requirements along all street frontages and the waiver of the requirement for any drainage improvements. Council suggested that a condition of the special permit be that the drainage ditch should be kept clean. On motion by Dr. Hall, seconded by Dr. Gunter, the following resolution was unanimously adopted by the following vote. Ayes: Mr. Buck, Mr. Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. WHEREAS, W. L. Mawyer and Ralph K. Wyland have applied for a special permit to use property owned by them for a manufacturing and processing establishment of a craft nature; and WHEREAS, such application has been duly advertised as provided by law and has been the subject of a public hearing jointly held by this Council and the City Planning Commission on July 13, 1982; and WHEREAS, the City Planning Commission has recommended approval of such special permit, now, therefore, be it RESOLVED by the Council of the City of Charlottesville, Virginia, that: t) The property located in a B-3 Business District at 1709 Monticello Road, designated as Parcels 32 and 33 on City Real Property Tax Map 61, is hereby granted a special permit for use as a ,manUfacturifig and pro- cessing establishment of a craft nature" as permitted under Section 31-93 of the City Code. 2) City Council finds that such use conforms to the requirements for special permits generally imposed by Article XX (Section 31-218 et seq.) of Chapter 31 of the City Code, and this permit is subject to all conditions and restrictions imposed generally by such article. 3) Such special permit shall be conditioned upon development of the property in accordance with the site plan submitted with the special permit application, including conditions imposed by the Planning Commission, and as finally approved by the Director of Planning. 4) As a further condition of such special permit the owners of such property shall maintain the existing drainage ditch on the property in an open free-flowing condition at all times. On motion by Dr. Hall, seconded by Mrs. Gleason, an ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION 21-8 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1976, AS AMENDED, SUCH AMENDED SECTION RELATING TO THE DISPOSAL OF UNCLAIMED PERSONAL PROPERTY" was offered and carried over to the next meeting for consideration. On motion by Mrs. Gleason, seconded by Dr. Hall, an ordinance entitled "AN ORDINANCE TO REPEAL SECTIONS 6-5, 6-6 and 6-7, AS AMENDED, OF THE CODE OF THE CITY OF CHARLOTTESVILLE AND TO AMEND CHAPTER 6 OF SUCH CODE BY ADDING A NEW SECTION NUMBERED 6-7.1, THE REPEALED AND ADDED SECTIONS RELATING TO THE PERPETUAL CARE FUND FOR CITY CEMETERIES" was offered and carried over to the next meeting for consideration.
