<br />RESOLUTIONS: Mr. Hendrix stated that the two resolutions would officially request the

<br />LOCATION AND -~.~..~Virginia Department of Highways and Transportation to proceed with the

<br />HYDRAULIC ROAD project and request the Highway Department to acquire the necessary right of
<br />RIGHT OF WAY
<br />ACQUISITION way.

<br /> Mrs. Gleason moved the following resolutions, Dr. Gunter seconded, and
<br />the two resolutions were unanimously approved by Council.

<br /> WHEREAS, a public hearing was conducted on July 22, 1982, in the City
<br />of Charlottesville by representatives of the Commonwealth of Virginia,
<br />Department of Highways and Transportation, after due and proper notice, for
<br />the purpose of considering the proposed location and design of Hydraulic
<br />Road, from the Route 250 Bypass to Route 29, Emmet Street-, Project: U000-104-
<br />103, C-501 in the City of Charlottesville at which hearing aerial photographs,
<br />drawings and other pertinent information were made available for public
<br />inspection in accordance with state and federal requirements; and
<br />
<br /> WHEREAS, all persons and parties in attendance were afforded full
<br />opportunity to participate in the public hearing; and
<br />
<br /> WHEREAS, representatives of the City of Charlottesville were present
<br />and participated in the hearing; and
<br />
<br /> WHEREAS, this Council had previously requested the Virginia Department
<br />of Highways and Transportation to program this project; and
<br />
<br />WHEREAS, the Council considered all such matters; now, therefore be it
<br />
<br /> RESOLVED by the Council of the City of Charlottesville, Virginia that
<br />the location and major design features of the proposed Hydraulic Road
<br />project as presented at the public hearing are hereby approved; and be it
<br />further
<br />
<br /> RESOLVED that the City of Charlottesville requests the Virginia
<br />Department of Highways and Transportation to proceed with this project at
<br />the earliest practical date.
<br />
<br /> WHEREAS, Section 33.1-39 of the Code of Virginia, as amended by the
<br />1970 session of the General Assembly, authorizes the State Highway and
<br />Transportation Commissioner to acquire rights of way for the censtruction,
<br />reconstruction, alteration, maintenance and repair of public highways
<br />within municipalities on projects which are constructed wi~h state or
<br />federal participation; and
<br />
<br /> WHEREAS, Section 33.1-39, as amended, further provides that the State
<br />Highway and Transportation Commissioner may exercise such authority only
<br />upon receipt of official request from the city involved; now, therefore be
<br />it
<br />
<br /> RESOLVED by the Council of the City of Charlottesville, Virginia that
<br />the City hereby requests the State Highway and Transportation Commissioner
<br />to acquire the necessary rights of way for Project: U000-104-103, RW-201
<br />within the corporate limits of the City and to convey the title to such
<br />right of way to the City of Charlottesville and agrees to reimburse the
<br />Virginia Department of Highways and Transportation for five percent (5%)
<br />of all costs incurred in the acquisition and conveyance of such rights of
<br />way; and it is understood that such acquisitions will be handled by the
<br />Commissioner under established policies and procedures and his decision
<br />in all instances will be final.
