ORDINANCE: <br />REZONING LAND <br />LOCATED IN <br />SEMINOLE SQUARE <br />(2nd reading) <br /> <br />ORDINANCE: <br />REZONING LAND <br />LOCATED ON <br />SYCAMORE STREET <br />AND ST. CHARLES <br />AVENUE <br />(2nd reading) <br /> <br />ORDINANCE: <br />AMENDMENTS TO <br />ZONING <br />ORDINANCE <br /> <br />and incorporated by reference, and <br /> <br /> WHEREAS, by said Resolution dated January 1S, 1968 the Council of <br />the City of Charlottesville did reserve for the City the right to lay, <br />maintain, repair and operate its utility lines which are now or may be <br />installed in said area herein closed and vacated (emphasis suppli-~), <br />and <br /> <br /> WHEREAS, the City Public Works Department has indicated that it has <br />no intention nor any need to install any new utility lines which are not <br />now in existence, and <br /> <br /> WHEREAS, the property owner owning abutting property to the above- <br />described closed streets wishes to develop said property with the assurance <br />that no further utility lines will be installed, and <br /> <br /> WHEREAS, the Council of the Ci.ty Of Charlottesville is willing to <br />delete the language underscored above, "or may be installed," from its' <br />Resolution adopted January 15, 1968, <br /> <br /> NOW, THEREFORE, be it resolved by the Council of the City of <br />Charlottesville, that its Resolution dated January iS, 1968, closing <br />portions of Sonoma Street, Stonehenge Avenue, and ~he alley between <br />Monticello and Stonehenge Avenue, reserving unto the City the right <br />to lay, maintain, repazr and operate its utility lines which are now <br />in existence be and is hereby amended to delete the language "or may <br />be installed;" so that the Resolution of January IS, 1968 will read in <br />pertinent part, <br /> <br />and that this vacation shall not extinguish existing <br />utility line easements for telephone, electric and <br />T.V. cable lines in the area herein closed and vacated; <br />and provided further that the City retain and reserve <br />to itself the right to lay, maintain, repair and <br />operate its utility lines which are now in existence in <br />said area herein closed and vacated. <br /> <br /> BE IT FURTHER RESOLVED that the Clerk of the Council be and is <br />hereby directed to record this Resolution and sketch in the Clerk's Office <br />of the Circuit Court in the City of Charlottesville. <br /> <br />The ordinance entitled "AN ORDINANCE AMENDING AND REENACTING THE <br /> <br />DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING ORDINANCE OF <br /> <br />THE CODE OF THE CITY OF CHARLOTTESVILLE BY THE REZONING OF A PARCEL OF <br /> <br />LAND LOCATED IN SEMINOLE SQUARE" which was offered at the meeting of <br /> <br />October 4th was adopted by the following vote. Ayes: Mr. Buck, Mr. Conover, <br /> <br />Mrs. Gleason, Dr. Gunter, Dr. Hall.
