AN ORDINANCE EXPRESSING THE SENSE OF THE VOTERS OF <br />THE CITY OF CHARLOTTESVILLE THAT §18.1-363.1 OF THE <br />CODE OF VIRGINIA SHALL HAVE NO FORCE OR EFFECT WITH- <br />IN THE BOUNDARIES OF THE CITY OF CHARLOTTESVILLE <br />WHEREAS, A REFERENDUM WAS DULY HELD PURSUANT TO §15.1-29.5 OF THE CODE OF VIRGINIA ON <br />NOVEMBER 5,1974, TO DETERMINE WHETHER §18.1-363.1 COMMONLY KNOWN AS THE SUNDAY CLOSING LAW SHALL BE <br />EFFECTIVE IN THE CITY OF CHARLOTTESVILLE; AND <br />WHEREAS, SUCH BALLOTS WERE COUNTED AND THE RESULTS CERTIFIED BY THE COMMISSIONERS OF ELECTION <br />TO THE CIRCUIT COURT OF THE CITY OF CHARLOTTESVILLE; AND <br />WHEREAS, THE CIRCUIT COURT OF THE CITY OF CHARLOTTESVILLE HAS ENTERED AN ORDER ON NOVEMBER <br />15, 1974, PROCLAIMING THAT A MAJORITY OF THOSE VOTING AGAINST HAVING THE PROVISIONS OF §18.1-363.1 OF THE <br />CODE OF VIRGINIA BECOME EFFECTIVE IN THE CITY OF CHARLOTTESVILLE, THEREBY EXPRESSING THEIR SENSE THAT <br />SUCH LAWS ARE NOT NECESSARY, <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE, VIRGINIA THAT <br />§18.1-363.1 OF THE CODE OF VIRGINIA SHALL NOT BE EFFECTIVE WITHIN THE BOUNDARIES OF THE CITY OF <br />CHARLOTTESVILLE, VIRGINIA. <br />CLERK <br />ADOPTED BY THE COUNCIL <br />NOVEMBER 27, 1974 <br />AYES: MR. BARBOUR, MR. FIFE, MR. GILLIAM, <br />MRS.RINEHART AND MR. VAN YAHRES. <br />NOES: NONE. <br />PRESIDENT <br />AN ORDINANCE AMENDING AND REENACTING THE DISTRICT <br />MAP INCORPORATED IN SECTION 4 OF ARTICLE III OF <br />APPENDIX II OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1965, BY THE REZONING OF A PARCEL OF LAND LOCATED ON <br />THE NORTHWEST CORNER OF ROSE HILL DRIVE AND CHARLTON <br />AVENUE IN THE CITY OF CHARLOTTESVILLE. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT THE DISTRICT MAP INCORPORATED <br />IN §4 OF ARTICLE III OF APPENDIX II OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1965, BY AMENDED AND <br />REENACTED AS FOLLOWS: <br />SECTION 4. DISTRICT MAP <br />CHANGING FROM R-3 RESIDENTIAL DISTRICT TO B -OFFICE SHOP DISTRICT THAT PARCEL OF LAND LOCATED <br />AT THE NORTHWEST CORNER OF THE INTERSECTION OF ROSE HILL DRIVE AND CHARLTON AVENUE, INDENTIFIED AS PARCEL <br />28 ON CITY REAL PROPERTY TAX MAP 36, HAVING A 50 FOOT FRONTAGE ON CHARLTON AVENUE, AND CONTAINING 1,750 <br />SQUARE FEET. <br />CLERK <br />ADOPTED BY THE COUNCIL <br />DECEMBER 16, 1974 <br />AYES: MR. BARBOUR, MR. GILLIAM AND MRS. <br />RINEHART <br />NOES: MR. FIFE AND MR.
