RESOLUTIONS: APPOINTING VIEWERS TO CONSIDER CLOSING A PORTION OF AN The resolutions appointing viewers to consider closing a portion of an alley south of Edgehill Road and a portion of Johnny Cake Lane between Blue Ridge Road (East) and Blue Ridge Road (West) was moved by Mr. Barnes, seconded ALLEY SOUTH OF by Mrs. Gleason, and unanimously approved by Council. WHEREAS, this Council has received a petition requesting vacation of the fifteen-foot Wide alley along the rear of lots 7, 8 and 9 of "Colonial Heights" Block D, that portion being 23.2 feet in length and contiguous with the boundary of Lot'6B at the end of the alley furthest away from Edgehill Road; and WHEREAS, it appears to Council that. the notice required by Section 15.1-364 of the Code of Virginia (1950), as amended, has been duly advertised; and A PORTION OF JOHNNY CAKE LANE BETWEEN BLUE RIDGE RD. (EAST) & BLUE RIDGE RD. (WEST) NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Charlottesville~, that Ms. Mar~y Jane Haynes, Messrs.~W. J. Copeland and H. P. Winn, Jr. report ~n writing to Council what inconvenience, if any, would result from such vacation. WHEREAS, this Council has received a petition requesting vacation of the portion of Johnny Cake Lane between Blue Ridge Road. (East) and Blue Ridge Road (West), a distance of approximately 250 yards; and WHEREAS, it appears to Council that the notice required by Section 15.1-364 of the Code. of Virginia (1950), as amended, has been duly advertised; NOW, THEREFORE, BE IT RESOLVED by. the Council of the City of Charlottesville that Ms. Mary Jane Haynes, Messrs W. J. Copeland and H. P., Winn, Jr. report in writing to Council what inconvenience, if any, woUld, result from such vacation. ORDINANCE: INCREASING BUS FARES The ordinance entitled "AN ORDINANCE INCREASING FARES FOR CITY-TRANSIT SYSTEM" was approved by the following vote. Ayes: Mr. Barnes, Mr. Buck', Mrs. Gleason, Dr. Hall. Noes: None. Absent: Dr. Gunter. ORDINANCE: CLOSING A PORTION OF CLYDE ST. BETWEEN ELLIOTT & SYCAMORE Mr. Wiley stated that the petitioners had originally requested the closing of the entire portion of Clyde Street, but staff had recommended only closing a portion because adjoining prppe.rty owners did not want the alley blocked off. Mr. Berkley FalWell of Elliott Avenue stated that he would prefer to see the alley and Clyde Street.remain open. Mr. Len Hartman of Monticello Road also stated he would prefer the street to remain unchanged. Rev. Rudy Ramsey, pastor of the Charlottesville Christian Fellowship Church, stated that the advantage of closing the street would be to allow the 'church to own the parking lot. no desire to alter~the alley. Rev. Ramsey added that the church had Dr. Hall made a motion to approve the closing of Clyde Street and Mrs. Gleason seconded the motion. Mr. Wiley stated that the church would not be legally bound to allow through passage in the 'future. The ordinance entitled "AN ORDINANCE CLOSING, VACATING AND DISCONTINUING A PORTION OF CLYDE STREET" was denied by t~e following vote. Ayes: Dr. Hall. Noes: Mr. Barnes, Mr. Buck, Mrs. Gleason. Absent- Dr. Gunter. ORDINANCE: Mr. Huja presented the Planning CommissiOn's reasons for recommending REZONING PRO- 'PERTY ON approval of the rezoning as follows: 1) It is in harmony with the Land Use NORTH SIDE OF MONTICELLO AVE. Plan of the.Comprehensive Plan. 2) It would not have a significant adverse BETWEEN GLBASON ST. & impact on the surrounding properties. 3) It would permit the zoning district RIDGE ST. FROM B-2 TO B-3 boundary (M-l) to follow the property boundary.
