Staff Report re: Status of Rugby Rd. Bicycle Way/S~de- walk Project Staff Report: M.I.C.A. Contract 143 Engineer's Office. .- The City Manager stated that Mr. Agnor's reason for suggesting this alternative is that this official will see that the County ordinances are enforced, He will have the responsibility of looking after the Rivanna Reservior and that seems to make some sense in terms of placing him in the Rivanna organization would be controlled by the City and County, A motion by Mrs. 0'Brien, seconded by Mr. Albro that the position of Watershed Management Official be established, and this official placed in the Rivanna Water and Sewer Authority organization, to be paid on a 50/50 basis by the City and County, and that this individual be instructed to establish an on going monitoring program of changes that are occurring in the water- shed, was unanimously adopted. The City Manager reported that the City has reached an impass with one of the property owners in the Rugby Road Bicycle Way/Sidewalk project and it appears that the only way the issue can be resolved is to go to court. He stated it is a matter of whether the Council wishes to instruct the staff to settle the issue, go to court, or abandoned the project, and requested some direction as to how the Council wishes the staff to proceed. Mr. Albro stated he thinks the public should know the reason this matter has come back in this form is that the appraisals were done, assessments were made of the value of the property to be taken and damages to the residue of the property, and there is too much difference between the value of the take and the amount which the property owner would be satisfied. The Mayor stated he feels it is more than what we want to pay and he would not be in favor of going into litigation, so he would be in favor of abandoning the project, Mrs. O'Brien stated that she felt it appropriate that she move that the project be dropped, having been a long time supporter of this project and she does so with a great deal of regret. She stated she was sorry to see the project drapped because of~icycles on there, she knows it is dangerous, she thinks it would be a good thing for the community, but she doesn't know if one block of a bicycle path would do any good. A motion by Mrs. O'Brien, seconded by Mr. Albro that the Rugby Road Bicycle Way/Sidewalk Project be abandoned, was unanimously adopted. The City Manager advised the Council that the staff proposes to engage the services of a firm known as M.I.C.A. to provide certain management services for us which they guarantee will result in tangible dollar savings in excess of their fee. He stated their fee is $34,590 for one year, but we don't have to pay them if they don't save us more money than that. There is an alternative under which we would prepay them $29,651, which is a
