Staff Report re: <br />Status of Rugby Rd. <br />Bicycle Way/S~de- <br />walk Project <br /> <br />Staff Report: <br />M.I.C.A. Contract <br /> <br /> 143 <br /> Engineer's Office. .- <br /> <br /> The City Manager stated that Mr. Agnor's reason for suggesting <br /> <br /> this alternative is that this official will see that the County <br /> ordinances are enforced, He will have the responsibility of <br /> looking after the Rivanna Reservior and that seems to make some <br /> sense in terms of placing him in the Rivanna organization <br /> would be controlled by the City and County, <br /> <br /> A motion by Mrs. 0'Brien, seconded by Mr. Albro that the <br /> <br />position of Watershed Management Official be established, and <br />this official placed in the Rivanna Water and Sewer Authority <br />organization, to be paid on a 50/50 basis by the City and County, <br />and that this individual be instructed to establish an on going <br />monitoring program of changes that are occurring in the water- <br />shed, was unanimously adopted. <br /> <br /> The City Manager reported that the City has reached an <br /> <br />impass with one of the property owners in the Rugby Road Bicycle <br />Way/Sidewalk project and it appears that the only way the issue <br />can be resolved is to go to court. He stated it is a matter of <br />whether the Council wishes to instruct the staff to settle the <br />issue, go to court, or abandoned the project, and requested some <br />direction as to how the Council wishes the staff to proceed. <br /> <br /> Mr. Albro stated he thinks the public should know the reason <br /> <br />this matter has come back in this form is that the appraisals <br />were done, assessments were made of the value of the property <br />to be taken and damages to the residue of the property, and there <br />is too much difference between the value of the take and the <br />amount which the property owner would be satisfied. <br /> <br /> The Mayor stated he feels it is more than what we want to <br /> <br />pay and he would not be in favor of going into litigation, so <br /> <br />he would be in favor of abandoning the project, <br /> <br /> Mrs. O'Brien stated that she felt it appropriate that she <br /> <br />move that the project be dropped, having been a long time <br />supporter of this project and she does so with a great deal of <br />regret. She stated she was sorry to see the project drapped <br />because of~icycles on there, she knows it is dangerous, she <br />thinks it would be a good thing for the community, but she <br />doesn't know if one block of a bicycle path would do any good. <br /> <br /> A motion by Mrs. O'Brien, seconded by Mr. Albro that the <br /> <br />Rugby Road Bicycle Way/Sidewalk Project be abandoned, was unanimously <br />adopted. <br /> <br /> The City Manager advised the Council that the staff proposes <br /> <br />to engage the services of a firm known as M.I.C.A. to provide <br />certain management services for us which they guarantee will result <br />in tangible dollar savings in excess of their fee. He stated <br />their fee is $34,590 for one year, but we don't have to pay them <br />if they don't save us more money than that. There is an <br />alternative under which we would prepay them $29,651, which is a <br /> <br /> <br />
