230 <br /> <br />Association's other property in the neighborhood. <br /> <br /> The President of the Neighborhood Association, Mr. William <br />Duren, stated that the Board of the Neighborhood Association, <br />had voted to cease opposition to the proposed project, but had <br />-taken no final action on the Alumni Association's prpposal for <br /> <br />disposition of the other properties. When asked to clarify this <br />statement, he said that the neighborhood association had agreed <br />not to contest the granting of the special permit in court; <br />however, this decision was not binding on individual members of <br />the association or other property owners in the area. <br /> <br /> When asked for the Alumni Association's reaction to this, <br /> <br /> Mr. William Massie Smith stated that the Alumni Association had <br /> not previously heard of this decision on the part of the <br /> neighborhood association and could not therefore give an official <br /> reaction to it; however, he felt the neighborhood association's <br /> position was encouraging. <br /> <br /> Mr. Albro stated that while the agreement between the two <br /> associations with regard to disposition of the other properties- <br /> might be a matter of public interest, it was not properly part <br /> of Council's consideration of the special permit request. <br /> <br /> The Mayor agreed with Mr. Albro and indicated that he had <br /> <br /> just wanted the public to be brought up to date on the discussion <br /> between the associations. <br /> <br /> Mr. Buck asked the City Attorney whether it was improper <br /> <br /> for Council to condition the special permit on the Alumni Asso- <br /> ciation's agreement to carry out its proposal with regard to the <br /> isposition of its other properties in the Lewis Mountain <br /> Neighborhood. <br /> <br /> Mr. Wiley replied that Council cOuld impose conditions on <br /> <br /> the special permit only if those conditions related to the <br /> property ~for which the permit was granted. He further stated t.~ <br /> that in considering the special permit, Council should consider <br /> its impact on the surrounding area and decide whether the special <br /> permit complied with the standards set forth in the Zoning <br /> Ordinance. He said that while the interest of the Council and <br /> the public in discussions about the other properties was under- <br /> standable, those matters should not be allowed to influence <br /> Council's decision on the merits or demerits of the special <br /> permit application. <br /> <br /> Mr. Buck then inquired whether Council could impose a condition <br /> on the special permit limiting future expansion of Alumni Hall <br /> on the site for which the permit was granted. <br /> <br /> Mr. Wiley replied that such a limitation had been discussed <br /> <br /> by the Planning Commission. However, it had been decided that <br /> such a limitation would be superfluous because any future expansion <br /> would automatically require amendment of the special permit and <br /> a time limit imposed now could not bind a future Council in its <br /> consideration of a later amendment. <br /> <br /> <br />
