289 <br /> <br />Resolution re: <br />Authorizing <br />Charlottesville <br />Fire Company <br />to store certain <br />articles at the <br />Ridge Street Fire <br />Station <br /> <br />Resolution <br />Requesting Virginia <br />State Highway Dept. <br />to establish <br />priorities for <br />railroad crossings <br />in the City <br /> <br />The stand shall be operated in full conformity with <br />all state health and alcoholic beverage control <br />regulations. No food preparation shall be permitted <br />at the stand. The operator shall promptly remove <br />all food dishes, containers and utensils after each <br />customer has left, and shall thoroughly clean the <br />entire stand and surrounding area, as designated on <br />the attached map, after the close of business each day. <br /> <br />Within the designated area of the stand, the operator <br />shall have the right to limit access and occupancy <br />only to honafide paying customers who are behaving in <br />a lawful manner, and shall have the same right to deny <br />admission or service as it exercises on its own premises. <br />However, no person shall be denied access or service at <br />the~stand on the basis of race, religion, national origin., <br />sex or physical handicap. <br /> <br />By accepting this permit, the operator agrees to <br />indemnify the City and hold it harmless from all claims <br />from injuries or damages of any kind whatsoever, arising <br />out of its occupancy of the public right-of-way or <br />operation of the stand. The operator shall maintain in <br />force during the term of this permit public liability <br />insurance with a minimum of $300,000 single limit <br />coverage and shall furnish the City Attorney with <br />satisfactory evidence of such coverage. <br /> <br />This permit may be revoked by City Council at any time, <br />after a hearing conducted at any regular meeting <br />provided the operator has been notified of the hearing <br />by written notice delivered to his place of business <br />at least five days before such meeting, if the Council <br />finds that the operator is violating the terms of the <br />permit, or that the continued operation of the stand <br />poses a threat to the public health, safety and welfare <br />or constitutes a public nuisance. <br /> <br />Mr. Conover expressed some concern over the potential litter <br /> <br />problem the stand might create and after some discussion the <br /> <br />Council and the owner, Mr. Epstein, agreed to a designated area <br /> <br />around the stand through which the-employees would police the <br /> <br />litter and remove it. On motion by Mr. Albro, seconded by Mr. <br /> <br />Conover, the amended resolution was adopted by the following <br /> <br />vote.~ Ayes: Mr. Albro, Mr. Buck, Mr. Conover, Ms. Gleason, Dr. <br /> <br />Hall. -Noes: None. <br /> <br />On motion by Mr. Albro, seconded by Mr. Hall, the following <br /> <br />resolution was unanimously adopted by. Council: <br /> <br /> WHEREAS the Charlottesville Fire Company is the owner of <br />certain articles of personal property of historic interests <br />presently kept on the premises of the main fire station on Ridge <br />Street; and <br /> <br /> WHEREAS the Charlottesville Fire Company has requested <br />clarification of its authority to continue use of the Ridge Street <br />property for such purpose; now, therefore, be it <br /> <br /> RESOLVED by the Council of the City of Charlottesville that <br />the Charlottesville Fire Company is hereby authorized to maintain <br />a replica of the Liberty Bell in its present location on a pedestal <br />in front of the Ridge Street Fire Station, until further action <br />of this Council and <br /> <br /> BE IT FURTHER RESOLVED that the Charlottesville Fire Company <br />is also authorized to store an antique horse drawn steam fire <br />engine in the Ridge Street Fire Station, in a location to be <br />designated by the Chief of the Charlottesville Fire Department, <br />until further action by this Council; ~and <br /> <br /> BE IT FINALLY RESOLVED that the Charlottesville Fire Company <br />shall be fully responsible for the care and safekeeping of such <br />property and shall assume all risk of damage thereto and loss <br />thereof. <br /> <br />Council considered a resolution requesting the Virginia State <br /> <br />Department of Highways and Transportation to initiate a project <br /> <br />and establish priorities for the improvement of railroad crossings <br /> <br />within the corporate limits of the City. As explained by Mr. Bob <br /> <br />Stripling, Assistant City Manager, this resolution is the result <br /> <br />of citizen concerns about the safety of certain railroad crossings. <br /> <br /> <br />
