.3,66 <br /> <br />Staff report re: <br />Apple Classic <br />Bicycle Race <br /> <br />extra staff, and constituting an effective respnnse by the City to <br />the University neighborhood concerns about zoning violations as <br />expressed in the Neighborhood Study. Mr. Hendri× stated that if the <br />inspectors are refused entry and have probable cause to believe <br />that a violation exists, a search warrant would be sought to gain <br />entry. Mr. Albro suggested that occupants and owners be informed <br />hy inspectors of their right to refuse entry and Mr. Hendrix <br />agreed that there would be no problem in complying with this request. <br />Mr. Conover inquired what other sanctions are available if a <br />correction is not made. Mr, Hendrix stated that the City would <br />prosecute violators if necessary but there has never been a <br />situation that required it to date. Mr. Hendrix stated that usually <br />the unauthorized occupants are given until the end of the school <br />semester to move out of the unit and/or other methods of correction <br />are used, such as altering the structure of the unit to achieve <br />compliance. Mr. Conover asked if notice of violations are furnished <br />to landlords as well as tenants and Mr. Hendrix replied that they <br />were as it is the landlord's responsibility to be in compliance with <br />zoning regulations. Mr. Conover expressed the concern that.major <br />violations (with more than just a few un'authorized tenants residing <br />in one unit) could occur and wondered if giving the violators till <br />the end of t~he semester to move was an effective way to correct <br />vi61ations, since students and landlords could effect leases from <br />January through December with no effective action by the City. Mr. <br />Hendrix expressed his reluctance to apply the informal policy <br />on any kind of discriminatory basis and talked about the hardship to <br />students of having to move in the middle of the semester. After some <br />discussion, it was agreed to leave this matter to the discretion <br />of the staff. By common consent, Council approved the proposed <br />annual inspection program, with the understanding that City <br />inspectors would inform occupants of their right to refuse entry <br />at the time of random inspections. <br /> <br /> Mr. Bob Stripling, Assistant City Manager~ explained the results <br />of a recent survey of downtown residents, businesses and churches on <br />the Apple Classic Bicycle Race held 'in October. He stated that the <br />majority of complaints concerned correctable problems like traffic <br />management and parking. Those involved with this Second ~nnual <br />event felt generally pleased with the organization and turnout of <br />the race. The survey yielded the following recommendations for the <br />next race in October, 1981: (1) Make a more assertive effort to <br />notify area businesses and residents well in advance of the event; <br />(2) Study feasibility, of a later starting time, preferably after <br />church services; (3) Consider cost of printing more descriptive "no <br />parking" signs and seek a more suitable time for erecting signs; <br /> <br /> (4) Monitor more closely the noise levels as well as trash and litter <br /> deposits. Mr. Marc Kruger of Kruger Farms, the sponsor of the race, <br /> said he would be submitting his written report to Council within a <br /> week or two and commented that he was generally pleased with the race. <br /> <br /> <br />
