Watson II and Mr. <br /> William H. Lindaey were unanimously appointed to the Housing Board <br /> of Adjustments and Appeals. <br /> <br /> Mr. William A. Perkins, Jr., a member of the Perry Foundation <br /> which is the present owner of the Jessup house at the corner of <br /> <br />7th and High Streets, presented the foundation's appeal of the Board <br />of Architectural Review's recent decision to allow only conditional <br />demolitiOn of the building. The foundation contends that the <br />building is untenantable as is and would require more expensive <br />renovation than would be economically feasiable. The foundation <br />wishes to demolish the building which they believe would make the <br />parcel more attractive to a potential buyer of the Levy Opera House; <br />the foundation wishes to sell the two properties as a package if <br />possible. The Board of Architectural Review, at its November 19 <br />meeting, granted the application for demolition with the following <br />two conditions: (1) that the BAR review and approve a proposal <br />for what will take the building's place and (2) that a demolition <br />permit be tied to and part of permits for development of the <br />replacement. The foundation considers these conditions unreasonable <br />as they have no firm buyer at the moment and wish to demolish the <br />structure immediately as they consider it an eyesore and a health <br />hazard to the community. Mr. Cole Hendrix presented a report from <br />Mr. Carl F. Muse, Inspections Chief, who states the building is <br />a fire hazard with numerous defects (broken windows and doors <br />rotted roof, ruined brickwork, water.damaged flooring, trash <br />and debris)_ that is currently being used as shelter by vagrants <br />and has suffered a recent interior fire due to this use. His report <br />recommended demolition of the building if no improvements are made. <br />Mr. Albro inquired whether the BAR should hear the request again <br />as some circumstances have changed since their recent decision <br />(th~ interior fire has caused additional damage and neighboring <br />property owners have written le-ters expressing their opinions of <br />the matter). Mr, John Farmer, chairman of the BAR, suggested <br />that the BAR's decision would probably not be changed even in light <br />of changed circumstances and recommerdedpersonally that Council <br />proceed with its hearing of the appeal. Mr. Roger Wiley, City <br />Attorney, cited Section 31-140.2 of the City Code which states <br />that, when presented with a demolition application, the BAR may <br />eithe~ grant the certificate of appropriateness for the demolition <br /> <br /> <br />
