WardandPreCinct boundaries. <br />(4) Whether it is.possible to provide for a. City Council <br />elected part!yfrom wards 'in which the ward bou~darie~ <br />~l~.ap~roximate traditi0na% "neighborhood" boundaries. <br />· ~.)~ whethe it i~i~. r ~. ~i,~ii~po~sibl'e. t°pr°Vide for a .City Council <br />elected partly from.warlsWith a significantly'increased <br />Pr°babitity of election of a. bi'ack member of ~ity CoUncil, <br />or. of'~'~ber-residing ina hiSt°ricaliyunderrepresented <br />area~o~ the City. <br /> <br /> Ih the course .of determining these. matters, the CCSCC may~ <br />if it deems it dvmsable, propose one or more possible plans <br />for the di~isi0n 0fthe City int°~wards~ With the understanding <br />that-such proposals couldnot be binding on a future council <br />charge'with:the responsibility for such a division. <br /> <br /> The CC.SCC is requested to report its findings and recommenda- <br />tions to Council by August 1, 1981. <br /> <br />On motion, by Mr. Albro, seconded by Dr. Hall, Council <br /> <br />unanimously adopted the following resolUtion: <br /> <br />WHEREAS Steven .and Martha Tharpe have applied to Ci't~ <br />Council for a permit to operate an' outdoOr cafe on. the pedestrian <br />mall in the t00'block of'weSt Main Street, in connection with <br />the operation of their' duly licensed restaurant at 109 West <br />Main Street; and. <br /> <br /> WHEREAS this Council finds that the proposed outdoor cafe <br />in keePi~gwith the intent 0f~thepedeSt~ian mall, can add <br />Significantly to successful Commerce in the downtown area, <br />will not unreasonably restrict the movement of pedestrian <br />traffic and will not endanger thelpublic health, safety, or <br />welfare; now, therefore, be it <br /> <br />is <br /> <br /> RESOLVED that'Steven andMartha Tharpe are hereby granted <br />a permit to operate an outdoor cafe on the pedestrian mall <br />in the 100 block of West Main Street, subject to the following <br />conditions and terms: <br /> <br />The permit shall be. valid fromits adoption until <br />November 30, 1982, for operationof the cafe during the <br />monthao.f March through Nowembe=~ Not later than November <br />30 of each year, the operators shall remove from public <br />property all furniture and equipment used for such cafe <br />operation. <br /> <br />-.The cafe shall be operated only ~ <br /> mn the areas designated as <br /> Areas-A~and B on the attached sketch which is incorporated <br /> by reference in this resolution. NoCafe furnishings or <br /> equipment sha%l be permitted to °bstruct the area~designated <br /> as a fire land running~be~ween Areas A and B on such sketch. <br /> The designated a~eas's'hal~.beclearly delineated by the use <br /> ~f.~a~combination 0f ChainSi; Planters and barriers of a <br /> design to be finally approved by the~city Manager~ <br /> <br />The city Managershal!li~ewise apprqve final designs for <br />the cafe furniture, aWning!s or canOpies and other fiXtures or <br />equipment, robe used foropmrati0h of the cafe, including <br />the method, if any, by which such· items will'be anchored <br />to prevent permanent.d~mage to the mall Surface and to ensure <br />that the Cafe is compatibl~e.with the mall' deSign. <br /> <br />The cafe shall be operated, in'fUll conformity with all <br />St te health and al~oh°~ici'beUera e control re' ' <br /> ~ .. - ~ ~.. ..g gulatzons. <br />No food preparation shal~ be.permitted on the mall. <br />The operators shall prompt&y rem0ve.ail food dishes and <br />utensils after each cust0~r has'.left end'Shall thorOUghly <br />clean i'the entire cafe area~afterelOSe of business, each <br />day.
