The CC.SCC is requested to report its findings and recommenda- tions to Council by August 1, 1981. On motion, by Mr. Albro, seconded by Dr. Hall, Council unanimously adopted the following resolUtion: WHEREAS Steven .and Martha Tharpe have applied to Ci't~ Council for a permit to operate an' outdoOr cafe on. the pedestrian mall in the t00'block of'weSt Main Street, in connection with the operation of their' duly licensed restaurant at 109 West Main Street; and. WHEREAS this Council finds that the proposed outdoor cafe in keePi~gwith the intent 0f~thepedeSt~ian mall, can add Significantly to successful Commerce in the downtown area, will not unreasonably restrict the movement of pedestrian traffic and will not endanger thelpublic health, safety, or welfare; now, therefore, be it is RESOLVED that'Steven andMartha Tharpe are hereby granted a permit to operate an outdoor cafe on the pedestrian mall in the 100 block of West Main Street, subject to the following conditions and terms: The permit shall be. valid fromits adoption until November 30, 1982, for operationof the cafe during the monthao.f March through Nowembe=~ Not later than November 30 of each year, the operators shall remove from public property all furniture and equipment used for such cafe operation. -.The cafe shall be operated only ~ mn the areas designated as Areas-A~and B on the attached sketch which is incorporated by reference in this resolution. NoCafe furnishings or equipment sha%l be permitted to °bstruct the area~designated as a fire land running~be~ween Areas A and B on such sketch.
