Within the designated cafe areas, the operators· shall <br /> .haVe. the right to limit access.and occupancy only to <br /> bonafide paying Customers~of their'restaurant whO are <br /> behaving in a lawful manner and.shail~haVe the same right <br /> to deny admission or service as.theY!exercise On their <br /> own Premiaes. HOwever, no Person.~shaI! be denied access <br /> or service to the cafe on the basis of race, religion, <br /> national origzn, sex or physical handicap. <br /> <br />F. Operators may' Permit musical entertainment in the cafe <br /> a~ea, prOVided it is limited to unamplified vocal or <br /> instrumentaI performances and does not occur after 1.2:00 <br /> a.m. or before noon.. <br /> G. This. permit may be revoked~by CitY COuncil at any time <br /> after a hearin'g":.¢onducted a~.anYreguiar meeting, provided <br /> the operators have been notified of the hearing by written <br /> notice~deliver&d to their place ofbusiness at least five <br /> days before suchmeeting,~ifthe council 'finds that the <br /> operators are violating the terms of' the permit or that <br /> the continued operation of the~cafe P°ses a threat'to-the <br /> public'~health~ safety,and welfare or constitutes a <br /> publicnuisance. <br /> <br /> The ordinance entitled "AN'ORDINANCE TO AMEND AND REORDAIN <br /> ARTICLE IV OF CHAPTER21 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br /> VIRGINIA, 1976, AS AMENDED, BY AMENDING SECTIONS 21-17, 21-19 <br /> THROUGH 21-23 AND 21-25 THROUGH 21-28, AND BY ADDING A SECTION ~_ <br /> NUMBERED 21-25.1, THE AMENDED' AND ADDED SECTIONS PERTAINING TO <br /> THE REGULATION OF DEALERS IN PRECIOUSMETALS" which was offered <br /> at the meeting ofMay 41~was~considered on second reading. Ms. <br /> Sheila Haughey, Assistant City Attorney, explained some of the <br /> changes that had been made by her, most of which were made to <br /> conform to obligatory state requirements. Because there was <br /> some question as to how to interpret certain provisions of the <br /> state law, Ms. Haughey requested that Council defer the second <br /> reading of the ordinance to the next meeting to allow her to <br /> resolve some of these problems. By common consent, Council <br /> <br />agreed to Ms, Haughey's recommendation. <br /> <br /> Mr. Bernard Caperton,. an antiques de~ler doing business at <br />1113-w. Main Street, asked several questions regarding the <br />provisions of the ordinance. Ms. Haughey agreed to contact him <br />after .~he meeting to answer his questions, <br /> <br />Mr, Mac Luck of the Jefferson Coin Shop .at 301 E. Market <br />Street also made some comments regarding the provisions of the <br /> <br />proposed ordinance. <br /> <br /> The ordinance entitled UAN ORDINANCE TO AMEND AND RE.ORDAIN <br /> <br />ARTICLE I OF CHAPTER. 16 OF THE CODE OF THE ~CITY OF CHARLOTTESVILLE, <br />VIRGINIA, 1976, AS AMENDED, BY AMENDING SECTION 16-16 TO INCREASE <br />PARKING FINES," which was offered at the meeting of May 4, was <br />adopted by the following vote. Ayes: Mr. Alb~o, Mr. Buck, Mr. <br />Conover, Ms. Gleason, Dr. Hall. Noes: None. <br /> <br /> <br />
