Resolution re: Accepting valuation of Water and Sewer Facilities Resolution re: Special Permit - 631 Cutler Lane The, C'~%~y~ Manager presented a list of City owned Water and Sewer Facilities and valuations on each facility and stated this was done in conformance with an Agreement relating to the Rivanna Water and Sewer. Authority of 1973. On motion by .Mrs. Rinehart, seconded by Mr. Gilliam the following resolution was unanimously adopted. WHEREAS, pursuant to a four party agreemenn, dated June 12, 1973, and entered into by and between the City of Charlottesville, the Albemarle County Service Authority, the Board of Supervisors of Albemarle County, and the Rivanna Water and Sewer Authority, the City of Charlottesville agreed to sell the Rivanna Water and Sewer Authority agreed to purchase certain City facilities, as set forth in Section 3.4 and 3.5 of said four party agreement; and WHEREAS, the sale and purchase price of said facilities was set at their fair market value as of the date of said four party agreement, as determined by Paul B Krebs and Associates and McNair and Associates~ consulting engineers, less such amounts as may be paid to the City or the Service Authority, as the case may be, pursuann to Section 3.8 of said four party agreement on account of debt retirement; and WHEREAS, Paul B. Krebs and Associates and McNair and Associates, consulting ~ngineers, have determined the sale and purchase price of the said facilities in a Report on Valuation of Water and Sewer Facilities to be Purchased bY Rivanna Water a~d Sewer Authority from the City of Charlottesville and ~lbemarle~County Service Authority, dated January, 1975; NOW, .THEREFORE, BE IT RESOLVED by the Council of the City of Charlottesville that the Service Authority does hereby accept the valuation of the water and sewer facilities to be purchased bM the Rivanna Water and Sewer Authority from the City pursuant to said four party agreement, as determined in Water and Sewer Facilities t Water and Sewer Authority fr and Albemarle County Service Associates and Paul B.~Krebs engineers, dated January, 19 ~ Report on Valuation of p be Purchased by Rivanna ~m the City of Charlottesville Authority, of McNair and and Associates, consulting 5. A communication was presented from the Planning Commission stating that a public hearing had been held on a petition to rezone from R-1 to R-1 Special Permit for a private school, property located at 631 Cutler Lane. The Planning Commission made no recommendation since agreement could not be reached on this request. Mr. Gilliam did not participate in the discussion of this matter due to possible conflict of interest. On motion by Mrs. Rinehart, seconded by Mr. Van Yahres the following resolution was adopted by the following recorded vote. Ayes: Mr. Barbour, Mr. Fife, Mrs. Rinehart and Mr. Van Yahres. Noes: None. (Mr. ¢illiam, Abstained) BE IT RESOLVED by the Council of the City of Charlottesville that there is hereby granted pursuant h ' to Section 14 (e) of t e Zoning Ordinance of the City of Charlottesville, a Special Use Permit for the location and operation of a priyate school on the property known as 631 Cutler Lane identified as Parcel 2 on City Real Property Tax Map 47. Such permit shall be subject to the conditions and regulations set forth in Article 20 of the Zonzng Ordznance of the City of Charlottesville
