302 <br /> <br />Resolution re: <br />Special Use <br />Permit - Emmet <br />Street <br /> <br /> WHEREAS, this is ~atter of increasing concern to the <br />jurisdictions.of the Thomas Jefferson Planning District; <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Charlottesville recommends that the Council on Criminal Justice <br />be urged to revise its policies on accrued funds, to insure that <br />such accrued funds remain under the control of the Planning Districts <br />to which they were originally assigned by a fair and equitable <br />formula, to be used for programs offered to the Council on'Criminal <br />Justice as overage proposals in annual action grant programs. <br /> A communication was presented from the Planning Commission <br />recommending that a special permit be granted for a drive-in <br />restaurant on North Emmet Street between Arby's Roast Beef and <br />Hardee's Hamburger Restaurants. On motion by Mr. Brunton, <br />seconded by Mr. Gatewood the following resolution was unanimously <br /> <br />Consideration re: <br />Ordinance - Sewer <br />Work - regarding <br />permits <br /> <br /> adopted. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottes- <br /> ville that there is hereby granted pursuant to Section 31-86 of <br /> the Code of the City of Charlottesville, 1976, as amended, a <br /> special permit forithe use of property designated as parcel 2.4 <br /> on City Real Tax Map 40 for construction of a drive-in <br /> restaurant facility. Such permit shall be subject to the <br /> conditions and regulations setforth in the aforesaid Section 31-86 <br /> as well as genera! conditions and regulations imposed upon <br /> special permits by Chapter 31 of such City Code; provided however <br /> the customary requirement for two street entrances for a drive-in <br /> restaurant facility shall not be applicable. <br /> <br /> An ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> SECTION 5-24 AND 5-25 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br /> 1976, AS AMENDED, BY REQUIRING PERMITS TO BE OBTAINED FOR SEWER <br /> WORK AND REQUIRING PERMIT FEES TO BE CHARGED FOR SEWER WORK," <br /> was offered by Mr. Brunton, seconded by Mr. Barbour and carried <br /> over to the next meeting for consideration. <br /> <br />Consideration re: A communication was presented from the Planning Commission <br />Ordinance - Palatine <br />& Avon Street - recommending that the rezoning at the corner of Avon Street and <br />Denied <br /> Palatine Street ~be approved for only the southern parcels (lots <br /> <br />17 and 18) for the following reasons: <br /> <br /> 1. Existing B-2 zoned lots to the south are owned by the <br /> applicant and part of it falls in the flood plain. This <br /> additional rezoning of B-2 along with the existing B-2 <br /> could result in a usable piece of property for business. <br /> <br /> 2. In the opinion of the Commission this would still protect <br /> the residential environment to the~north of the property. <br /> <br />Mr. Brunton moved, and Mr. Fife seconded that an ordinance entitled <br />"AN ORDINANCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED <br />IN SECTION 31-4 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY <br />OF CHARLOTTESVILLE, 1976, BY THE REZONING OF A PARCEL OF LAND <br />FRONTING ON AVON STREET IN THE CITY OF CHARLOTTESVILLE," be denied <br />due to the fact that it would cause traffic hazards and other <br />adverse impacts. The motion to deny the ordinance carried by the <br />following recorded vote. Ayes: Mr. Barbour, Mr. Brunton, Mr. <br />Fife, and Mrs. O'Brien. NOes~, Mr. Gatewood. <br /> <br /> <br />
