Consideration re: An'ordinance entitled "AN ORDINANCE TO AMEND ARTICLE VI Ordinance - Collect ' a service charge OF CHAPTER 2 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976 on bad checks , AS AMENDED, BY ADDING A SECTION NUMBERED 2-63.1 TO AUTHORIZE THE CITY TREASURER TO COLLECT A SERVICE CHARGE ON BAD CHECKS," was offered by Mr. Fife, seconded by Mr. Gatewood and carried over to the next meeting for consideration. Consideration re: A communication was presenned from the Planning Commission Ordinance - Rezoning at Stribling Ave. recommending that the request for rezoning property on from R-2 to R-3 Denied Stribling Avenue at Dymond Road be denied for ~the following reasons: 8a5 Communication re: Comm. Atto. re: Employee pension plan for his employees Matters by Public: Jimmy Miller Appointment re: Building Code Board of Appeals Appointment re: Architectural Review Board Appointment re: Highway Safety Commission Resolution re: Highway Priorities 1. It would be contrary to the 1990 Land Use Plan. 2. It would encourage the development at a density which could not be adequately served by the City street system. ' 3. Construction at the proposed density would cause a destruction of a significant amount of vegetation and 'require construction on a significant slope. 4. Development. of single family attached dwellings allowed under the present zoning would be more compatible with the sur~ounding~area. 5. It would be a spot zone and would be incompatible with the existing uses. 6. A planned unit development for this area would be better use of the land and a more compatible use of the 1And and provide control at a better density. On motion by Mt.Fife, seconded by Mr.Barbour the Planning Commissions recommendation was unanimously, adopted. A communication was presented from Mr. Richard H. Barrick, Commonwealth's Attorney requested that the employees of his office be included in the City's pension plan. An ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION 20-19 OF THE CODE OF THE CITY OF CHARLOTTESVI~LLE, 1976, AS AMENDED, RELATING TO DEFINITIONS," was offered by Mr. Fife, seconded by Mr. Barbour and carried over to the next meeting for consideration. Mr. Jimmy Miller addressed th~~ Council and questioned the sale of the City's water and sewage treatment facilities, which apprears to the contrary to the City Charter. The City Attorney advised Mr. Miller that the State Code supersedes the City Charter in the transfer of these facilities to a regional authoriny. On motion ~y Mr. Brunton, Mr. Sam Darnell was reappointed to the Building/Code Board of Appeals; by unanimous vote. On motion by Mr. Fife', Mr. Joseph Keller was reappointed to the Architectural Review Board, by unanimous vote. On motion by Mr. Gatewood, Mr. Frank Johnstone was appointed to the Highway Safety Commission, by unanimous vote. The City Manager advised the Council that in discussions with the Virginia Department of Highways and Transportation they had suggested that maybe the City Council wished to include Ridge Street from Fifth Street in its first highway construction priority. On motion by Mr. Fife, seconded by Mr. Brunton the following resolution was unanimously adopted.
