next meeting for con~i~teration. <br /> <br />Consideration re: An'ordinance entitled "AN ORDINANCE TO AMEND ARTICLE VI <br />Ordinance - Collect ' <br />a service charge OF CHAPTER 2 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976 <br />on bad checks , <br /> AS AMENDED, BY ADDING A SECTION NUMBERED 2-63.1 TO AUTHORIZE <br /> <br /> THE CITY TREASURER TO COLLECT A SERVICE CHARGE ON BAD CHECKS," <br /> was offered by Mr. Fife, seconded by Mr. Gatewood and carried <br /> over to the next meeting for consideration. <br /> <br />Consideration re: A communication was presenned from the Planning Commission <br />Ordinance - Rezoning <br />at Stribling Ave. recommending that the request for rezoning property on <br />from R-2 to R-3 <br />Denied Stribling Avenue at Dymond Road be denied for ~the following <br /> <br /> reasons: <br /> <br />8a5 <br /> <br />Communication re: <br />Comm. Atto. re: <br />Employee pension <br />plan for his <br />employees <br /> <br />Matters by Public: <br />Jimmy Miller <br /> <br />Appointment re: <br />Building Code <br />Board of Appeals <br /> <br />Appointment re: <br />Architectural <br />Review Board <br /> <br />Appointment re: <br />Highway Safety <br />Commission <br /> <br />Resolution re: <br />Highway Priorities <br /> <br /> 1. It would be contrary to the 1990 Land Use Plan. <br /> 2. It would encourage the development at a density <br /> which could not be adequately served by the City <br /> street system. ' <br /> 3. Construction at the proposed density would cause a <br /> destruction of a significant amount of vegetation <br /> and 'require construction on a significant slope. <br /> 4. Development. of single family attached dwellings <br /> allowed under the present zoning would be more <br /> compatible with the sur~ounding~area. <br /> 5. It would be a spot zone and would be incompatible <br /> with the existing uses. <br /> 6. A planned unit development for this area would be <br /> better use of the land and a more compatible use of <br /> the 1And and provide control at a better density. <br /> <br /> On motion by Mt.Fife, seconded by Mr.Barbour the Planning <br /> Commissions recommendation was unanimously, adopted. <br /> <br /> A communication was presented from Mr. Richard H. Barrick, <br /> Commonwealth's Attorney requested that the employees of his <br /> office be included in the City's pension plan. An ordinance <br /> entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION 20-19 <br /> <br />OF THE CODE OF THE CITY OF CHARLOTTESVI~LLE, 1976, AS AMENDED, <br />RELATING TO DEFINITIONS," was offered by Mr. Fife, seconded <br />by Mr. Barbour and carried over to the next meeting for <br />consideration. <br /> <br /> Mr. Jimmy Miller addressed th~~ Council and questioned the <br />sale of the City's water and sewage treatment facilities, which <br />apprears to the contrary to the City Charter. The City Attorney <br />advised Mr. Miller that the State Code supersedes the City <br />Charter in the transfer of these facilities to a regional <br />authoriny. <br /> <br /> On motion ~y Mr. Brunton, Mr. Sam Darnell was reappointed <br /> to the Building/Code Board of Appeals; by unanimous <br /> vote. <br /> <br /> On motion by Mr. Fife', Mr. Joseph Keller was reappointed <br /> <br /> to the Architectural Review Board, by unanimous vote. <br /> <br /> On motion by Mr. Gatewood, Mr. Frank Johnstone was appointed <br /> to the Highway Safety Commission, by unanimous vote. <br /> <br /> The City Manager advised the Council that in discussions <br />with the Virginia Department of Highways and Transportation they <br />had suggested that maybe the City Council wished to include <br />Ridge Street from Fifth Street in its first highway construction <br />priority. On motion by Mr. Fife, seconded by Mr. Brunton the <br />following resolution was unanimously adopted. <br /> <br /> <br />
