Noes: None.

An ordinance entitled "AN ORDINANCE CLOSING, VACATING AND
DISCONTINUING UNOPENED OAK RIDGE AVENUE IN THE CITY OF
CHARLOTTESVILLE," was offered by Mrs. O'Brien, seconded by

Mr. Albro and carried over to the next meeting for consideration.

The City Attorney advised the Council that a petition has
been received to vacate the unimproved block of Hedge Street
which lies between 2nd and 3rd Streets. He stated that an
application was filed in 1976 to vacate this street, but
was denied due to opposition by residents of the neighborhood.
He stated that the viewers appointed were not in agreement
over this closing; one thought it was all right to close it,
one was opposed to the closing, and the third thought there
would be some inconvenience resulting from the closing, but
that it should be closed anyway. The staff comments were to
the effect that there appears to be some pedestrian use and that
it is a logical right-of-way to be reserved for traffic circulation
in the future although construction on it might be somewhat
difficult because of the grade. Mr. Robert Mussleman, Attorney
for the petitioner addressed theCouncil in support of the
petition. He also S. tated the petitioner had no objection to
a pedestrian easement through the property. After some
discussion action on this matter was deferred until the next
meeting.

473
