had conformed to the code as presently written but that <br />the staff, Planning Commission and Council could certainly <br />consider future changes in the procedure. <br /> <br /> Mr. Albro then moved, and Mr. Gatewood seconded, <br />adoption of the resolution granting the special permit as <br />prepared by .the ~City Attorney. <br /> <br /> A substitute motion by Mrs. O'Brien, seconded by Mr. <br />Buck, that each aspect of the special permit application <br />be voted on separately was adopted by the following recorded <br />vote. Ayes: Mr. Brunton, Mr. Buck, and M_rs. O'Brien. <br />Noes: Mr. Albro and Mr. Gatewood. <br /> <br /> A motion was-made by Mr. Albro and seconded by Mr. <br /> <br /> Buck that the special permit requested pursuant to <br /> ~31-33 for the development-at a density of 87 units per <br /> acre or a maximum of 91 units, be granted. Mr. Albro <br /> stated that in his view all the objective requirements <br /> found in ~31'33 for higher density permits had been <br /> satisfied or exceeded by the applicant in this case. He <br /> indicated that the general standards for granting special <br /> permits set forth in §31-220 had likewise been met, and <br /> that there would not be undue adverse impact upon the <br /> adjacent neighborhood if the special permit for higher <br /> density were approved. He stated he feels that the access <br /> problems had been adequately addressed~by the traffic <br /> division's studies, the noise impact would be adequately <br /> controlled by'the conditions that were included in the <br /> Planning commission recommendation; and there would be <br /> minimal impact from traffic congestion, light, dust, <br /> odor and other matters addressed in ~31-220. Furtmer, <br /> in his vi~ew, the density as proposed would have a potentially <br /> beneficial impact which he felt was the relevance of the <br /> economic benefit and arguements related to increased tax <br /> base cited'by the Planning Commission. <br /> <br /> Mr. Buck stated that while there had been objections <br /> voiced against some aspects Of this project he had not <br /> heard any opposition to the increased density. He too <br /> felt the increased number of residents would be benefiaial <br /> to the downtown area. The motion to grant the increased <br /> residential density was then unanimously adopted. <br /> <br /> The motion w~s made by Mr. Gatewood and seconded by <br /> <br /> Mr. Albro that a special permit be granted pursuant to <br /> ~31-140.1 for the proposed building to be constructed to <br /> a maximum height of 75 feet from grade to cornice line. <br /> <br /> Mrs. O'Brien stated that it had been the finding of <br /> <br /> the Architectural Review Board that the building wOuld be <br /> too high for the area, and after having viewed the site <br /> it was also her opinion that the building was too high for <br /> the area. <br /> <br /> <br />
