Mr. aspect of the special permit <br /> <br /> application gave him the most concern of the three but it was <br /> his final judgement that the design would not have an <br /> adverse affect on the area. Mr. Brunton stated that he <br /> had given due consideration to the comments of the <br /> Architectural Review Board and the Planning Commission and <br /> thanked them for their efforts. However, he stated that <br /> after repeated views of the site, the most recent of which <br /> had occurred earlier that day, and considereation of the <br /> models and drawings submitted by the applicant he had <br /> concluded that the height of the project would not have an <br /> undue adverse impact on the surrounding area. <br /> <br /> The motion~to grant a special permit for construction <br /> <br /> to a maximum height of 75 feet was then adopted by the <br /> following recorded vote. Ayes: Mr. Albro, Mr. Brunton, Mr. <br /> Buck and Mrs. Gatewood. Noes: Mrs. O'Brien. <br /> <br /> A motion was then made by Mr. Albro and seconded by Mr. <br /> Gatewood that the requested modifiction to the required front <br /> and rear yard sen backs be granted pursuant to §31-228.1. <br /> <br /> Mr. Albro stated that §31-228.1 says the exception <br />should be necessary or desirable in view of the nature, <br />circumstances, location or situation of the project. He <br />stated that the architect had had to work with a variety <br />of problems in terms of limitation on the site, the building <br />height, percentage coverage and other requirements imposed <br />by the ordinance. He therefore felt that the decreased <br />sen backs were necessary and desirable and that they were <br />in part a trade-off for the courtyard or plaza area included <br />in the design which he felt tied in to Lee Park visually <br />and thus made the set backs appropriate. A motion to <br />grant the set back modifications was then unanimously <br />adopted. <br /> <br /> The following resolution was then offered in its <br />entirety by Mr. Albro, seconded by Mr. Gatewood and adopted <br />by the following recorded vote. Ayes: Mr. Albro, Mr. <br />Brunton, Mr. Buck, Mr. Gatewood and Mrs. O'Brien. Noes: <br /> <br /> WHEREAS, CF Corporation has applied for special <br />permit for several aspects of a proposed high density <br />residential and commercial development for the property <br />comprising the city block bounded by Jefferson, Third, <br />High and Second Streets, N. E.; and <br /> <br />Hone. <br /> <br /> WHEREAS, such application has been duly advertised, <br />and has been the subject of public hearings jointly <br />conducted by .t~his Council and the City Planning Commission, <br />and of review and comment by the Board of Ar~chitectural <br />Review, all as provided by law; and <br /> <br /> WHEREAS, the granting of such special permits has <br />been recommended to Council by the Planning Commission. now <br />therefore, be itt ' ' <br /> <br /> RESOLVED hy the Council of the City of Charlottesville, <br />Virginia, that: <br /> <br /> <br />
