Resolution re: Granting <br />special permit for property <br />on McInt±re Rd. & Harris <br />Street <br /> <br /> of any individual residential <br /> of any portion of the proposed <br />project, the~City Attorney shall approve proposed <br />measures to insure ownership and maintenance of <br />common areas and facilities, and the applicant shall <br />certify to the City Attorney that such documents have <br />been duly recorded. <br /> <br />(e) The noise level from the operation of mechanical <br />equipment installed in such building shall not exceed <br />60 dba at any property line. <br /> <br />(f) The applicant shall take appropriate measures <br />to combine the four parcels of land comprising the <br />subject property into a single parcel. <br /> <br /> A communication was presented from the Planning Commission <br />recommending that the application for a special use permit <br />to use the property located at McIntire Road and Harris <br /> <br />Street north of the Lane High School Football Field fence <br /> <br />as a central recycling center be granted for the following <br />reasons: 1. It is in harmony with the 1990 Land Use Plan; <br />2. It will not have a significant adverse impact on the <br />neighborhood; and 3. The proposed project would be an <br />asset to the community. Mrs. O'Brien stated that she would <br />like to see the sign changed. She stated that the sign <br />as shown on the original site plan is consistent with the <br /> <br />type of signs used at the public parks and this type of <br />sign designates this type of public facility. Mr. Wiley <br />indicated that the sign and maintenance responsibility <br />could be covered in the lease. A motion_by Mrs. O'Brien, <br />seconded by Mr. Albro that the special permit be <br /> <br />granted, deleting the condition pertaining to sign, which <br />will be taken care of in the lease, was unanimously adopted. <br />On motion by Mrs. O'Brien, seconded by Mr. Albro the <br />following resolution was unanimously adopted. <br /> <br /> WHEREAS, the City of Charlottesville has applied <br />for a special permit to use a portion of the property <br />owned by it, at the intersection of McIntire Road and <br />Harris Street, designated as Parcel 134.1 on City Real <br />Property Tax Map 35, as a public utility facility, <br />specifically a central community facility for the collection <br />of used glass, aluminum, paper and other recyclable <br />materials; and <br /> <br /> WHEREAS, such application has been duly advertised <br />as provided by law, and has been the subject of a public <br />hearing jointly held by this Council and the City:Planning <br />Commission on January 9, 1979; and <br /> <br /> WHEREAS, the City Planning Commission has <br />recommended approval of such special permit; now, therefore, <br />be it <br /> <br /> RESOLVED by the Council of the City of Charlottes- <br />ville, Virginia, that: <br /> <br />(1) The property located at the intersection of <br />Mclntire Road and Harris Street, designated as <br />Parcel 134.1 of City Real Property Tax Map 35, <br />is hereby granted a special permit for use as <br />a public facility, specifically a community <br />recycling center, as permitted under Section 31-14 <br />of the City Code. <br /> <br />(2) The Council finds that such use conforms to <br />the requirements for special permits generally <br />imposed by Article XX (Section 31-218'et seq.) <br />of Chapter 31 of the City Code, and this permit <br />is subject to all conditions and restrictions <br />generally by such article. <br /> <br /> <br />
