10 <br /> Mr. Schilling asked if a fee schedule could be set up rather than a fine so it is not <br />ambiguous. <br /> <br /> Ms. Knake said there are limitations on the types of things the City can impose a <br />fee for. She said the class of misdeme anor could be lowered. Ms. Knake said another <br />alternative might be for the City to adopt a fine to cover the cost to the City to remove the <br />snow. <br /> <br /> Mr. Lynch said he does not think that would be useful as Public Works employees <br />already have to work around the clock to remove snow on public property. He said he <br />thinks it is appropriate for the judge to make a judgment as to the appropriate fine <br />because that is what they are appointed to do. He said we need to make sure that the City <br />keeps the same standar d of performance. He said we may want to rethink this for extra <br />big snows. <br /> <br /> Ms. Richards asked how the requirement will be enforced, and Mr. O'Connell said <br />that there will be some inspections, but it will also be complaint driven. He said a good <br />educati onal program is needed. He said the goal is to get the sidewalks cleared, but said <br />we have to use judgment regarding the amount of snow. <br /> <br />On motion by Mr. Lynch, seconded by Mr. Caravati, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAINING SECT ION 28 - 25 OF ARTICLE I, <br />CHAPTER 28 OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATING TO SNOW REMOVAL FROM STREETS AND SIDEWALKS" was <br />offered and carried over to the next meeting for consideration. <br /> <br />ORDINANCE <br />: LICENSING AGREEMENT AT PIEDMONT VIR GINIA <br />COMMUNITY COLLEGE FOR DOG PARK <br /> <br /> Mr. O'Connell said that staff has been looking at options for dogs and has been <br />working with Piedmont Virginia Community College to provide a dog park. <br /> <br /> Mr. Pat Plocek, Parks Manager, said that access to the 10 - 12 a cre parcel of land <br />at PVCC will be off Avon Street. He said fencing and a water connection will cost <br />$30,000 and is proposed to be shared by the City (25%), Albemarle County (25%), and <br />dog owners (50%). Maintenance is estimated to cost $2,500 a year. A license agreement <br />needs to be approved between the City and PVCC. <br /> <br /> Mr. Schilling said that the licensing agreement only refers to the City being <br />responsible for maintenance, and Mr. Plocek explained that there will be a separate <br />agreement between the City and County, but PVCC wanted to deal with only one <br />municipality. <br /> <br /> Mr. Schilling said he will be more comfortable when he sees documentation that <br />the County will participate. <br /> <br /> Mr. Lynch noted that the agreement has a termination clause that could be used <br />should the County decide not to participate. <br /> <br /> Mr. Plocek said construction will not begin until the money is in place. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Caravati, the ordinance approving the <br />license agreement between the City and PVCC for a dog p ark was offered and carried <br />over to the next meeting for consideration. <br /> <br /> Ms. Richards asked if there will be a similar mechanism for sharing liability and <br />security costs, and Mr. Plocek said that animal laws will be enforced by Albemarle <br />County, but the C ity will open and close the gates. He said once the agreement is <br />approved there will be a meeting with dog owners so they can start raising money. <br /> <br /> Ms. Richards suggested that a sponsorship program be developed. <br /> <br />
