11 <br /> Mr. Cox said he has heard from previous users of Riverview Park that they have <br />stopped using that park because there are not enough people there to feel safe. <br /> <br /> Mr. Plocek said that there has been a reduction in the number of dog owners who <br />go to Riverview Park, but he feels a significant number of people still use the park. <br /> <br />APPROPRIATION <br />: $221,000 - PAYMENT FROM PARAMOUNT THEATER FOR <br />nd <br />UNDERGROUND UTILITIES (2 reading) <br /> <br /> Mr. Caravati said he was frustrated at the last meeting about this issue, but he will <br />support the appropriation. <br /> <br /> Mr. Lynch said his concern is that there is an expectation that the undergrounding <br />utility funds will be matched with 50% private funds, and regardless of what the <br />undergrounding area is, he thinks there should be a 50% match in the future. <br /> <br /> The $221,000 appropria tion of payment from the Paramount Theater for <br />nd <br />undergrounding utilities, which was offered at the September 2 meeting, was approved <br />by the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards. Noes: <br />Mr. Schilling. <br /> <br />BE IT RESOLVED <br /> by t he Council of the City of Charlottesville, Virginia, that <br />$ 221,000 to be received from Paramount Theater, Inc. is hereby appropriated into <br />account 26 - 280 - 051683 - 50111 in the Capital Fund for undergrounding utilities in the <br />area. <br /> <br />This appropriation is c onditioned upon receipt of $221,000 from Paramount <br />Theater, Inc. funds and no City funds will be spent for the above - stated purpose until the <br />City receives the full amount. <br /> <br />nd <br />ORDINANCE <br />: PARKING - DISTANCE FROM CURB (2 reading) <br /> <br /> Police Chief Tim Longo ex pressed concern that moving the distance from the <br />curb to 18 inches increases the risk to property and is a matter of public safety. Chief <br />Longo said he thinks the ordinance can be enforced equitably. He said allowing 18 <br />inches puts cars into the traffic lane and bike lanes in some areas of the City. He said <br />good points were made by Councilors at the last meeting, but he thinks public safety <br />should prevail. <br /> <br /> Mr. Schilling said he is convinced by Chief Longo's argument that the distance <br />should be changed to 12 inches. He said we should specify where the distance is <br />measured, and suggested that it be the distance from the farthest tire. Mr. Schilling noted <br />that in some areas you can park more than 18 inches from the curb and still be within the <br />parking m arkings. <br /> <br /> Mr. Longo said an option would be to specify that you park no farther than 12 <br />inches where marks do not exist. <br /> <br /> Mr. Schilling asked what happens in places were there is no curb, and Mr. Longo <br />said the intent is not to limit it to curbs, but to the surface of the roadway. <br /> <br /> Mr. Lynch made a motion to amend the ordinance to change the distance to 12 <br />inches from the curb, Mr. Caravati seconded the motion, and the ordinance was amended <br />by the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. <br />Schilling. Noes: None. <br /> <br /> Mr. Caravati made a motion to amend the ordinance to specify the distance be <br />measured from the curb, or from the edge of the pavement where there is no curb, Mr. <br />Schilling seconded the motion, and the ordinance was amended by the following vote. <br />Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br /> <br />
