52 <br /> <br />TIME FOR REGULAR MEETINGS OF CITY COUNCIL" was offered and carried over <br />to the next meeting for consideration. <br /> <br />PUBLIC HEARING/ORDINANCE: ABANDONING GAS EASEMENT <br />(MONTGOMERY RIDGE SUBDIVISION) <br /> <br /> Mr. Craig Brown, City Attorney, explained that a different route for gas lines has <br />been agreed upon, and it is recommended that the old gas easement be abandoned. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Hamilton, the ordinance entitled "AN <br />ORDINANCE AUTHORIZING THE ABANDONMENT OF A NAURAL GAS <br />EASEMENT GRANTED TO THE CITY BY VIRGINIA LAND, LLC" was offered and <br />carried over to the next meeting for consideration. <br /> <br />REPORT: DECAL LICENSE CHANGES <br /> <br /> Ms. Lisa Kelley, Assistant City Attorney, said that the City of Virginia Beach has <br />requested that Charlottesville stop ticketing their citizens for failure to display a local <br />automobile decal. She said that the Department of Motor Vehicles collects taxes for <br />them and they do not require a decal. She said that only one other locality in Virginia, <br />York County, does not require decals. She said that DMV is no longer accepting this <br />responsibility from other localities. She said that when cars from Virginia Beach are <br />ticketed, they can mail in proof that their car is registered in Virginia Beach and the ticket <br />will be dismissed. Ms. Kelley presented three options for Council's consideration: 1) <br />alter enforcement of the City's ordinance so that no tickets are issued until the locality in <br />which the vehicles resides is determined; 2) sell a decal to residents of localities that do <br />not require it; or 3) continue the status quo. Ms. Kelley said that staff is looking for <br />direction from the Council. <br /> <br /> Mr. Lynch asked what it would take to have mobile equipment which would <br />allow officers to determine the locality from the license plate, and Ms. Kelley said that <br />money is the issue, but she does not know what this would cost. <br /> <br /> Mr. Schilling asked how many tickets are we talking about, and how many are <br />from Virginia Beach. <br /> <br /> Police Chief Tim Longo said that he would guess there are not a significant <br />number of tickets issued. He said the Police Department is moving in the direction of <br />mobile data, but are two years away from it. He said there will be significant <br />infrastructure cost. He said this now has to be done over the radio. <br /> <br /> Mr. Schilling asked about the possibility of purchasing cell phones for all officers <br />so they could use those to ascertain the information, but ChiefLongo said this would <br />create tremendous traffic for the Emergency Control Center. <br /> <br /> Mr. Schilling said he would like to find a way to work around this without <br />spending a lot of money. He said he does not like any of the suggestions. <br /> <br /> ChiefLongo said staffing is an issue at the E-911 Center. He said calls would <br />have to be made for any car with no decal. <br /> <br /> Mr. Schilling said he would like to study other creative ideas and is not inclined to <br />jump through hoops for Virginia Beach. He said he would like to find some way to <br />mitigate the situation with the existing system. He said we may need to ask for enabling <br />legislation. <br /> <br /> Ms. Hamilton asked if the same cars are repeatedly ticketed, and Ms. Kelley, said <br />yes, especially for U. Va. students and their visiting parents. <br /> <br /> <br />
