10 <br /> <br /> Mr. Brown said that this is a routine request made when VDOT is ready to accept <br />a road. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Lynch, the ordinance entitled "AN <br />ORDINANCE TO QUITCLAIM NATURAL GAS LINES LOCATED IN ROADWAYS <br />IN THE SOUTH FOREST LAKES SUBDIVISION IN ALBEMARLE COUNTY TO <br />THE VIRGINIA DEPARTMENT OF TRANSPORTATION" was offered and carried <br />over to the next meeting for consideration. <br /> <br />ORDINANCE: CONVEYING RIGHT OF WAY ON MONTICELLO/DRUID <br />AVENUE (2nd reading) <br /> <br /> Mr. Brown said that the City has been asked to convey a small piece of property <br />to the adjacent property owners. At the first reading of the ordinance Council asked for <br />the approximate cost of building a sidewalk, which could be built by the applicant in <br />exchange for the property. Mr. Brown said the sidewalk would cost approximately <br />$6,548 which is close to the fair market value of the property with a water line easement <br />maintained. Mr. Brown said the ordinance has been revised to indicate that the property <br />will be exchanged for construction of a City standard sidewalk. If acceptable, a contact <br />will be entered into with the applicant, and once the sidewalk is accepted, the property <br />will be conveyed. <br /> <br /> Mr. Lynch made a motion to amend the ordinance to indicate that construction of <br />the sidewalk will be adequate consideration for transfer of the property, and Mr. Schilling <br />seconded the motion. <br /> <br /> Mr. Harris, applicant, clarified that he will pursue having a private contractor <br />construct the sidewalk which he feels will be faster and cheaper. Mr. Harris asked <br />Council to consider allowing him to use curb and guttering to match what is just to the <br />west as opposed to constructing a sidewalk. He said this change seems to be acceptable <br />to the City engineer. <br /> <br /> Mr. Lynch said he thinks having the entirety of the sidewalk built is appropriate <br />given the value of the land conveyed. He expressed concern about letting that <br />requirement go. <br /> <br /> The ordinance was amended by the following vote. Ayes: Dr. Brown, Mr. <br />Caravati, Ms. Hamilton, Mr. Lynch, Mr. Schilling. Noes: None. <br /> <br /> The ordinance entitled "AN ORDINANCE AUTHORIZING THE <br />CONVEYANCE OF CITY-OWNED PROPERTY AT THE INTERSECTION OF <br />MONTICELLO AVENUE AND DRUID AVENUE TO LANDON AND SUZANNE <br />HARRIS," as amended, which was offered at the July 6th meeting, was approved by the <br />following vote. Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. <br />Schilling. Noes: None. <br /> <br />ORDINANCE: CLOSING OLD 5TM STREET, S.W. (2nd reading) <br /> <br /> Mr. Brown explained that the ordinance includes the option proposed by Southern <br />Development at the first reading, to provide four affordable housing units within two <br />years of final site plan approval; a sales price in the $150,000 range, and requires <br />Piedmont Housing Alliance to identify and pre-qualify eligible buyers during a 90 day <br />period. Mr. Brown said that concerns were raised with Southern Development's attorney <br />that if the units are not sold within 90 days then they may be sold by the developer. Mr. <br />Brown said that the equity appreciation issue is not clear and he foresees the need for <br />Southern Development, PHA and the City to enter into a contract. <br /> <br /> <br />
