Mr. Tolbert said that the Planning Commission recommended approval of the special <br />permit. <br /> <br /> Mr. Lynch said that concern was expressed at the Planning Commission meeting <br />about the massing and design of the building. <br /> <br />Mr. Frank Piatkowski, applicant, presented Council with new drawings. <br /> <br /> Mr. Schilling thanked the applicant for coming to his house and presenting him <br />with drawings. Mr. Schilling said his opposition to the project originally was because the <br />zoning is not supported by the Comprehensive Plan. He said he plans to abstain on <br />voting on the special permit. <br /> <br /> Mr. Lynch made a motion to approve the special permit and Dr. Brown seconded <br />the motion. <br /> <br /> Mr. Lynch said he appreciates the work of the applicant and feels they have gone <br />beyond the City's goal for affordable housing. He said he is satisfied that the buildings <br />do not have an institutional look. <br /> <br /> The special permit for increased density for Linden Town Lofts was approved by <br />the following vote. Ayes: Dr. Brown, Ms. Hamilton, Mr. Lynch. Noes: Mr. Caravati. <br />Abstaining: Mr. Schilling. <br /> <br /> WHEREAS, pursuant to the Code of the City of Charlottesville, sections {}34-156 <br />et seq. (Special Use Permits) and {}34-740 and {}34-796 of the City Code, Ms. Eliza <br />Wojtaszek ("Applicant") has requested a special use permit to authorize residential <br />density of approximately 26.24 dwelling units per acre (i.e., 26 dwelling units, total) on <br />the property located at 1013 Linden Avenue, City Tax Map 61 Parcel 52 ("Subject <br />Property"); and <br /> <br /> WHEREAS, the subject parcel is zoned "HW" (Highway Corridor District), <br />where, pursuant to {}34-740 and {}34-796 of the City Code, residential density of more <br />than 21 dwelling units per acre is allowed only by Special use Permit; and <br /> <br /> WHEREAS, a joint public hearing on this application was held before the City <br />Council and Planning Commission on October 12, 2004, following notice to the public <br />and to adjacent property owners as required by law; and <br /> <br /> WHEREAS, on October 12, 2004, based on the information presented by <br />Neighborhood Development Services staff as well as by the Applicant, the Planning <br />Commission recommended that the application be approved as submitted; and <br /> <br /> WHEREAS, this City Council finds and determines that granting the Special Use <br />Permit would be consistent with the City's zoning ordinance and the criteria generally <br />applicable to special use permits under Chapter 34 of the City Code; now, therefore, <br /> <br /> BE IT RESOLVED by the Charlottesville City Council that a special use permit <br />is hereby granted to allow the residential development of the Subject Property at a density <br />of approximately 26.24 dwelling units per acre (26 dwelling units, total), subject to the <br />following conditions designed to protect against adverse impacts on the surrounding <br />neighborhood and community: <br /> <br /> Use and development of the Subject Property for the approved residential use <br />shall at all times be in accordance with provisions of the City's zoning ordinance <br />(including the requirement of approval of a final site plan for the Subject Property) and <br />other applicable City ordinances, state and federal laws and regulations. <br /> <br />RESOLUTION: ADOPTION OF HOUSING STRATEGY <br /> <br /> Mr. Tolbert reviewed the key decisions points and action that were discussed at <br />the previously held work session: 1) definition of affordable housing; 2) creation of <br /> <br /> <br />
