Dr. Brown said he feels this report illustrates the value of the system. <br /> <br />RESOLUTION: APPROVING DEQ LANDFILL FINANCIAL ASSURANCE <br />AGREEMENT <br /> <br /> Mr. Brown said that DEQ requires a local government guarantee if Rivanna Solid <br />Waste Authority cannot meet its obligation for remediation of environmental conditions <br />at the Ivy Landfill. Mr. Brown said that in the past RSWA has been required to obtain a <br />line of credit, but in this case that would cost in the range of $160,000 to $250,000 <br />annually. He said an addendum has been added to the DEQ form which in effect states <br />that the obligations of the localities are moral obligations rather than binding legal <br />guarantees, but they are awaiting DEQ approval of this addendum. Mr. Brown said staff <br />recommends approval of the agreement presented. <br /> <br /> Mr. Lynch said he agrees we need to move forward. He said that RSWA is <br />ultimately backed by the City and County already. He said that once the solid waste cost <br />sharing agreement is approved he will be comfortable moving on this. <br /> <br /> Mr. Brown said that the deadline for RSWA to submit the documentation to DEQ <br />is February 26. Mr. Brown said action could be delayed if the cost sharing agreement is <br />settled within two weeks. <br /> <br /> Mr. Caravati said he will begrudgingly support the agreement even though it does <br />not say anything about splitting of costs. He said he will not go over 33% in the cost <br />sharing agreement for the City' s share. <br /> <br /> Dr. Brown said he would just as soon see the agreement pass. He said it is pretty <br />unlikely that we will solve the cost sharing agreement issue in two weeks. <br /> <br /> Ms. Hamilton made a motion to approve the DEQ financial assurance agreement <br />and Dr. Brown seconded the motion. <br /> <br /> Mr. Lynch said that ultimately this agreement needs to move forward but we need <br />to nail down the cost sharing. He said he is willing to meet with the County <br />representatives to try to finalize the agreement. He said issues remain with the escrow <br />account. <br /> <br /> The DEQ financial assurance agreement was approved by the following vote. <br />Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. Schilling. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that <br />this Council hereby authorizes the City Manager, or his designee, to sign the following <br />document, in form approved by the City Attorney. <br /> <br />Agreement ("Local Government Guarantee"), and attached Addendum, between <br />the City of Charlottesville/County of Albemarle and the Rivanna Solid Waste <br />Authority re: Compliance with Financial Assurance Regulations of Virginia <br />Department of Environmental Quality (with respect to Ivy Materials Utilization <br />Center). <br /> <br />APPROPRIATION: TRANSFER $15,000 TO SCHOOLS FOR ESL PROGRAM <br /> <br /> Mr. Lynch said that meetings have been held with the International Rescue <br />Committee and the Schools to discuss the influx of refugees into the City. He said that <br />this year was the largest increase ever for the English as a Second Language program. <br />Last year 170 students were served by five teachers, and this year the number increased <br />by 60 with no increase in the number of teachers. He said the teachers are stretched <br />extremely thin. He said he feels we have a moral responsibility to deal with this <br />population, but there is also a financial aspect to it as these students will only have a one <br />year exemption from No Child Left Behind requirements. He proposed that the City <br />provide $15,000 from the reserve which will be matched with $22,000 from the Schools. <br /> <br /> <br />
