Abstaining: Mr. Caravati. <br /> <br /> Mr. Lynch made a motion to approve the annual budget appropriation, as <br />amended above, Ms. Hamilton seconded the motion, and it was carried over to the special <br />meeting on April 11th. <br /> <br /> It was clarified that the funding for Mountainside would be for one year only and <br />out of the capital contingency fund. <br /> <br /> Mr. Brown suggested that Council amend the tax levy ordinance to reflect the <br />new tax rate. <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Lynch, the ordinance entitled “AN <br />ORDINANCE TO ESTABLISH THE ANNUAL TAX LEVY ON VARIOUS CLASSES <br />OF PROPERTY FOR THE PAYMENT OF INTEREST AND RETIREMENT OF THE <br />CITY DEBT, FOR THE SUPPORT OF THE CITY GOVERNMENT AND CITY <br />SCHOOLS, AND FOR OTHER PUBLIC PURPOSES” was amended to reflect a $1 tax <br />rate by the following vote. Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, <br />Mr. Schilling. Noes: None. This ordinance was carried over to the special meeting on <br />th <br />April 11. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: ZONING FEE SCHEDULE CHANGES RE: <br />PODS PERMIT FEES <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, said that when <br />Council adopted the ordinance regulating PODS, staff recommended that the temporary <br />use permit fee be charged, but did not realize at the time that this fee was $250 which was <br />later felt to be too high. He said the PODS business owners have made suggestions about <br />the ordinance. He recommended that the fee be changed to $50, with the first seven days <br />on the property waived. <br /> <br /> The public hearing was opened. <br /> <br /> Mr. Barton Mullins, co-owner of PODS, said that the ordinance has affected his <br />business. He said they often work with non-profits. He said the need for PODS is very <br />prominent. <br /> <br /> Mr. Wesley Mullins, co-owner of PODS, said that they would prefer to see a <br />grace period of 15 days to give two full weekends to load and unload PODS. He said he <br />would also like to see a lower fee as many of their clients are low-income. <br /> <br /> Ms. Valerie Long, attorney for PODS, said they want to work to propose <br />workable amendments to the ordinance regulating PODS. She said they support <br />regulations, but want to make sure they are reasonable. She said she thinks a $15 fee, <br />which is 11% of the rental fee, and waiving of the fee for 15 days is reasonable. She said <br />she thinks that a $50 fee will disproportionately affect lower income clients. She said she <br />will raise other concerns about the ordinance regulating PODS with the Planning <br />Commission. <br /> <br /> As there were no further speakers, the public hearing was closed. <br /> <br /> Responding to a question from Mr. Caravati, Mr. Tolbert said that the ordinance <br />previously adopted by Council allows a maximum of 60 days for a POD on site within a <br />12 month period. <br /> <br /> <br />
