9 <br /> Dr. Brown said he likes expanding the requirement to include someone living or <br />working in the City. He said this requirement could be reconsidered by Council if the <br />properties do not sell. <br /> <br /> Mr. Taliaferro and Mr. Norris said they would agree to that. <br /> <br /> Mr. Taliaferro made a motion to approve the resolution amending the contract <br />with Piedmont Housing Alliance for the sale of property on John Street, with the <br />requirement amended to include a person who has lived or worked in the City for a year. <br />Ms. Hamilton seconded the motion and it was approved by the following vote. Ayes: Dr. <br />Brown, Ms. Hamilton, Mr. Lynch, Mr. Norris, Mr. Taliaferro. <br /> <br />BE IT RESOLVED <br /> by the Council for the City of Charlottesville, Virginia that <br />the City Manager is authorized to execute on behalf of the City the attached amendment <br />to the Contract for the sale of City-owned property on John Street to Piedmont Housing <br />. <br />Alliance, in form approved by the City Attorney <br /> <br />ORDINANCE <br />: AMENDING TO INFILL DEVELOPMENT ORDINANCE <br /> <br /> Mr. Brown explained that in July Council approved a zoning classification change <br />that applied only to property with less than two acres. He said one application was in the <br />pipeline when the ordinance was approved, and had already been the subject of a public <br />hearing. He proposed that the effective date of the ordinance be revised so that this <br />application, which is the only one that would be affected, can proceed. He said this <br />action would not imply that the zoning application is supported or not. <br /> <br /> Mr. Tolbert said that it is an issue of fairness. <br /> <br /> On motion by Mr. Norris, seconded by Mr. Taliaferro, the ordinance entitled “AN <br />ORDINANCE TO AMEND CHAPTER 34 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE (1990), ARTICLE I (ADMINISTRATION), DIVISION 8 <br />(SPECIAL USE PERMITS)” was offered and carried over to the next meeting for <br />consideration. <br /> <br />RESOLUTION <br />: AUTHORIZING PROCUREMENT FOR ENGINEERING <br />SERVICES FOR OLD LYNCHBURG ROAD <br /> <br /> Mr. Tolbert said staff wanted to bring this issue to Council to make sure it is <br />something Council wants to do. He estimated that $1 million to $2 million in <br />improvements are needed on Old Lynchburg Road. He said basic engineering work and <br />a survey needs to be done, with the engineering work alone estimated to cost between <br />$100,000 and $200,000. Mr. Tolbert cautioned Council that moving forward with the <br />engineering work will create an expectation that they will follow through and do the <br />work. Mr. Tolbert said there is the possibility that some funds could be obtained through <br />proffers associated with the Biscuit Run development. <br /> <br /> Mr. Lynch said it would be hard to live up to all of the neighborhood <br />expectations. He noted that he has no intention of closing Old Lynchburg Road. He said <br />that this is one of the few radial spoke roads in the City with no sidewalk. He said we <br />need to make sure we have support for them. He said there is no right-of-way for bike <br />lanes, and it is probably not within the City’s financial ability to pull that off. He said we <br />may not be able to do everything to fix the drainage, which is a private system. He said it <br />might be worth looking into the developer’s responsibility regarding drainage. He said <br />we can probably only do sidewalks on one side. <br /> <br /> Mr. Tolbert said the minimum cost to do anything will be $1 million. <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Hamilton, Council authorized the <br />procurement of engineering services for Old Lynchburg Road by the following vote. <br />Ayes: Dr. Brown, Ms. Hamilton, Mr. Lynch, Mr. Norris, Mr. Taliaferro.
