14 <br /> Mr. Huja moved the Resolution Granting a Special Permit for Increased Density <br />at 1311 Wertland Street, adding the requirement of two street trees. Mr. Taliaferro <br />seconded the motion, and it was approved by the following vote. Ayes: Dr. Brown, Ms. <br />Edwards, Mr. Huja, Mr. Norris, Mr. Taliaferro. Noes: None. <br /> <br />WHEREAS <br />, Mehdi Akbarzadeh, owner of the property at 1311 Wertland Street, <br />has requested a special use permit to increase the density of such property from 15.4 units <br />per acre to 46 units per acre in order to replace commercial space with two (2) one- <br />bedroom apartments; <br /> <br />WHEREAS <br />, following a joint public hearing before this Council and the <br />Planning Commission, duly advertised and held on May 13, 2008, this Council finds that <br />such use is allowed under City Code Sections 34-458 and 34-480, and will conform to the <br />criteria applicable to special permits generally under Chapter 34 of the City Code; now, <br />therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to Mehdi Akbarzadeh to allow <br />increased density from 15.4 units per acre to 46 units per acre of property at 1311 <br />Wertland Street. This special use permit is conditioned upon: <br /> <br /> <br />1.The applicant must provide one (1) off-site parking space for each residential unit, <br />th <br />for a total of two (2) parking spaces, either at the 14 Street parking garage, or <br />with 1,400 feet of the site, and provide the City with written verification that the <br />parking requirement has been met. <br /> <br />2.If for any reason the use of the off-site parking spaces is limited or discontinued, <br />the applicant will be responsible for finding alternative parking spaces within 30 <br />days or cease use of the building until the parking requirement is met. <br /> <br />3.Two (2) streetscape trees, as defined in City Code Sec. 34-870, shall be planted <br />by the applicant on the property. <br /> <br />ORDINANCE <br />: EXPANDING $200 ENHANCED SPEEDING FINES TO: ELLIOTT <br />AVENUE (MONTICELLO AVENUE TO RIDGE STREET); BRANDYWINE DRIVE <br />(HYDRAULIC ROAD TO YORKTOWN DRIVE); AND FRANKLIN STREET <br />nd <br />(NASSAU STREET TO MARKET STREET) (2 reading) <br /> <br /> Mr. Taliaferro stated his opposition to the ordinance. He said he thinks the fine is <br />excessive and the data has not shown it reduces speeding. <br /> <br /> Mr. Huja said he has similar concerns, except for Franklin Street where he heard <br />from neighbors. <br /> <br /> Mr. Norris noted that Council received a petition from Elliott Avenue residents <br />supporting the fine. <br /> <br /> Dr. Brown said he never thought it was a good idea. He agreed with Mr. <br />Taliaferro and said people will have trouble paying the fine. <br /> <br /> Ms. Edwards said the goal is to change driving behavior. She said we need to <br />change the culture so it is safe for everyone. <br /> <br /> Dr. Brown noted that staff wanted to expand the fine to more streets to get more <br />data. <br /> <br /> Mr. Norris said that the fine makes sense on certain streets, but if Council feels <br />this is too much, he is okay with reducing the number. <br /> <br /> Ms. Edwards asked if we do not do this, how do we address speeding concerns? <br /> <br /> Mr. Huja said through better signage and traffic calming. <br /> <br /> <br />
