4 <br /> <br /> RESOLUTION <br />f.: Authorize Transit Application for State Funds <br /> <br /> <br />BE IT RESOLVED by the Charlottesville City Council that the Transit Manageris <br />PUBLIC <br />authorized, for and on behalf of the City of Charlottesville, hereafter referred to as the <br />BODY <br />, to execute and file an application to the Department of Rail and Public Transportation, <br /> DEPARTMENT <br />Commonwealth of Virginia, hereafter referred to as the, for a grant of financial <br /> PUBLIC BODY <br />assistance in the amount of $ 7,718,800 to defray the costs borne by the for <br />DEPARTMENT <br />public transportation purposes and to accept from the grants in such amounts <br />DEPARTMENT <br />as may be awarded, and to authorize the Transit Manager to furnish to the such <br />documents and other information as may be required for processing the grant request. <br />The Charlottesville City Council certifies that the funds shall be used in accordance with <br /> PUBLIC BODY <br />the requirements of Section 58.1-638.A.4 of the Code of Virginia, that the will <br />provide funds in the amount of $ 0, which will be used to match the state funds in the ratio as <br />PUBLIC <br />required in such Act, that the records of receipts of expenditures of funds granted the <br />BODYDEPARTMENT <br /> may be subject to audit by the and by the State Auditor of Public <br />PUBLIC BODY <br />Accounts, and that funds granted to the for defraying the expenses of the <br />PUBLIC BODY <br />shall be used only for such purposes as authorized in the Code of Virginia. <br />PUBLIC BODY <br />The undersigned duly qualified and acting Clerk of Council of the certifies that <br />the foregoing is a true and correct copy of a Resolution, adopted at a legally convened meeting of <br />the Charlottesville City Council held on the 21st day of September, 2009. <br /> RESOLUTION <br />g.: Authorize Azalea Park Master Planning Process <br /> <br />BE IT RESOLVED <br />by the Council of the City of Charlottesville, Virginia thatthis <br />Council hereby authorizes the City Manager and the Parks and Recreation Department to begin <br />the Park Master Planning Process for Azalea Park, pursuant to the Park Master Planning Process <br />adopted by City Council on March 16, 2009. <br /> <br /> RESOLUTION <br />h.: Reprogramming of CDBG and HOME Funds <br /> <br />WHEREAS <br /> , the City of Charlottesville previously approved the FY 09-10 CDBG and <br />HOME budget for submission to HUD for review and final approval , and <br />WHEREAS <br /> , Charlottesville Abundant Life Ministries was to be funded $25,000 in <br />CDBG funds and Habitat for Humanity of Greater Charlottesville was to be funded $80,000 <br />HOME funds, and <br />WHEREAS <br /> , HUD determined that the $25,000 CDBG allocation for Charlottesville <br />Abundant Life Ministries is not an eligible expense under federal law; now, therefore <br />BE IT RESOLVED <br /> by the City Council of Charlottesville, Virginia, that the <br />Charlottesville Abundant Life Ministries be funded $25,000 in HOME funds and Habitat for <br />Humanity be funded $25,000 in CDBG funds and $55,000 in HOME funds. <br /> <br /> RESOLUTION <br />i.: Lease of City Land to Art in Place <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that the City <br />Manager is hereby authorized to execute on behalf of the City the following document, in form <br />approved by the City Attorney: <br /> <br />License Agreement between Art in Place Foundation and the City of <br />Charlottesville dated October 1, 2009. <br /> <br /> ORDINANCE <br />j.: “AN ORDINANCE AMENDING AND REORDAINING <br />SECTION 34-972 OF ARTICLE IX (GENERALLY APPLICABLE REGULATIONS) OF <br />CHAPTER 34 (ZONING) OF THE CHARLOTTESVILLE CITY CODE, 1990, AS <br />AMENDED, RELATING TO RESTRICTIONS ON FRONT YARD PARKING IN <br />COMMERCIAL AND MIXED USE DISTRICTS” (carried over) <br /> <br /> <br />
